<br />At a regular meeting of the City Council held on February 13,

<br /> Rev. Jack Stallings, Pastor, Collinswood Freewill Baptist Church, opened the meeting with
<br />prayer, followed by the Pledge of Allegxance to the Flag.
<br />
<br />Mayor Davis welcomed all visitors in attendance.
<br />

<br /> 78-427 (f) - On motion of Mr. Gray and seconded by Mr.
<br />approved on first reading at the regular meeting of January
<br />following vote:

<br />Early, the following resolution
<br />23, 1979, was adopted and by th~
<br />
<br />"A RESOLUTION GRANTING A USE PERMIT TO LONDON REALTY COMPANY TO OPERATE A
<br />DESIGNED SHOPPING CENTER ON LONDON BOULEVARD.
<br />
<br /> WHEREAS, London Realty Company, made an application, pursuant to Section 40-58.1(e) of
<br />the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as herein
<br />described; and
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things required to be
<br />done in connection with said application; and
<br />
<br />fter-

<br />WHEREAS, the Planning Commission has recommended the granting of said use permit.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br />1. That the ~se for which the use permit hereinafter is sought:
<br />
<br /> (a) Wil~ ~bt a~versely affect the health and safety of persons residing or
<br />working in the neighborhood of the proposed use;
<br />
<br /> (b) Will not be detrimental to the public use or injurious to the property or
<br />improvements in the neighborhood; and
<br />
<br />(c) Will be in accord with the purposes of the Zoning Chapter of the City Code.
<br />
<br /> 2. London Realty Company is hereby granted a use permit pursuant to Section 40-68.1(e)
<br />of the City Code to operate a designed shopping center at the property described as follows:
<br />
<br /> Beginning on the northwest intersection of London Boulevard and Goode Way;
<br />thence westerly along the north right of way of London Boulevard approximately
<br />288'; thence north 523.79' to the south right of way line of Enterprise Way;
<br />thence east along said right of way approximately 283' to the ~est right of way
<br />line of Goode Way; thence south along said right of way approximately 505' to
<br />London Boulevard, the Point of Origin.
<br />
<br />3. This use permit is approved subject to the following conditions:
<br />
<br /> That delivery hours of products sold at the shopping center shall be limited between
<br />the hours of 7:00 A. M. to 9:00 P. M."

<br />
<br /> 79-22 - The following ordinance approved on first reading at the regular meeting of
<br />January 23, 1979, was taken up and read:
<br />
<br /> "AN ORDINANCE TO APPROPRIATE $4,807,204 FROM THE COMMUNITY DEVELOPMENT FUND FOR
<br /> THE 1979 CO~qUNITY DEVELOPMENT PROGRAM."
<br />
<br /> On motion of Mr.
