February 27, 1979 <br /> <br />(e) <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO HENRY AND DORIS~WILDER, BY THE REVEREND <br />RUDOLPH LEWIS, MINISTER, TO OPERATE A HOUSE OF WORSHIP ON THE SOUTHWEST CORNER <br />OF CHESTNU% AND COUNTY~STREETS. <br /> <br /> WHEREAS, Henry and Doris Wilder, by the Reverend Rudolph Lewis, Minister, made an <br />application pursuant to Section 40-71(b) of the Code of the City of Portsmouth, Virginia, <br />1973, for the granting of a use permit as hereinafter described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be <br />done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the grantmng of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit hereinafter sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working <br />in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; and <br /> <br />(c) Will be in accord with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. Henry and Doris Wilder, by the Reverend Rudolph Lewis, Minister, is hereby granted <br />a use permit pursuant to Section 40-71(b) of the City Code to operate a House of Worship <br />at the property described as follows: <br /> <br /> Beginning on the sQuth side of CQunty Street approximately 425' <br />west of its intersection with Effingham Street; t~ence south 90'; thence <br />west 113'; thence north 90' to the south right-of-way line of County Street; <br />thence east along said right-of-way 113' to the Point of Origin. <br /> <br />This use permit is approved subject to the following conditions: <br /> <br /> ~a) The use of the building situate within the property described herein shall be <br />used as a temporary House of Worship for a period not to exceed two (2) years. <br /> <br /> (b) Ail statutes, ordinances and <br />must be complied with and an acceptable <br />officials relative to the occupancy of <br /> <br />policies of federal, state and municipal governments <br />plan must be submitted to the proper municipaI <br />this structure as a place of public assembly. <br /> <br />Ayes: Gray, Holley, <br />Nays: None <br />Abstaining: Elliott <br /> <br />Oast, Davis <br /> <br /> 79-34 %he following ordinance approved on,first reading at the Public Hearing of <br />February 12, 1979, was taken up and read: <br /> <br />(f} <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, 1973, AS AMENDED, <br />PERTAINING TO DIMENglONgL' REQUIREMENTS IN RESIDENTIAL R-75 ZONED DISTRICTS. ' <br /> <br /> On motion of Mr. Gray and seconded by Mr. Oast, the ordinance was adopted, and by the <br />following vote: <br /> <br />Ayes: Elliott, Gray, Holley, Oast, Davis <br />Nays: None <br /> <br /> ?9-35 - The follow!~g letter fromtthe City Manager concerning Peachtree PUD, Section <br />7, d~ferred from the Public Hearing of February 12, 1979, was presented: <br /> <br /> "As you will recall a major change in Section seven of the Peachtree Planned Unit <br />Development was presented to City Council at its Eebruary public hearing for concurrence <br />as ~quired by the City's PUD ordinance. As a result of the discussion by Council concernin <br />the amount of recreational amenities left to be completed in Peachtree and the de~eloper's <br />desire to provide tess than that originally proposed due to a significant reduction in density, <br />you asked that the City Attorney and I meet with the developer to resolve this matter prior <br />to final action being taken on section seven. <br /> <br /> Mr. Tayloe and members of my staff have met and arrived at sufficient concurrence in <br />order to allow final consideration of section seven. This coneurrence is based upon the <br />developer providing additional recreation facilities and pedestrian circulation, which will <br />increase the overall utilization of the development's central recreation area. The exact <br />design and location of these facilities are now being finalized and will be completed prior <br />to the bonding of section seven, which is required before the first building permit can be <br />issued. <br /> <br /> To summmrize the proposed improvements include the construction of a juvenile activity <br />area adjacent to the pool and club house in lieu of four tot lots and a ball field and in- <br />creased pe~estri'an ~athways in and around the central recreation area leading from and tied <br />into the existing and~pK9~osed public sidewalk system. What has been prcposed will not be <br />more than a 40% reduction in,what was initially required for ~he development. Any additional <br /> <br /> <br />
