February 27, 1979 <br /> <br />At a regular meeting of the City Council held on February 27, 1979, there were present: <br /> <br />Richard J. Davis, Archie Elliott, Jr., J. Robert Gray, James W. Holley~ <br />Edward L. Oast, Jr., Robert T. Williams, City Manager, Gordon B. Tayloe, Jr.~, <br />City Attorney. <br /> <br />Absent: Jack P. Barnes, E. Saunders Early, Jr. <br /> <br /> Rev. Lee V. Ruckman, Jr., Pastor, West End United Methodist Church, opened the meeting <br />with prayer, followed by the Pledge of Allegiance to the Flag. <br /> <br />Mayor Davis welcomed all visitors in attendance. <br /> <br /> Motion of.~. Elliott and seconded by Mr. Holley, minutes of the ~ublic Hearing of <br />February 12, 1979; minutes of the called meeting of February 13, 1979; minutes of tee regular <br />meeting of February 13, 1979, to be approved as received, and was adopted by unanimous vote. <br /> <br />- UNFINISHED BUSINESS <br /> <br /> 79-34 - The following ordinance approved on first reading at the Public Hearing of <br />February 12, 1979, was taken up and read: <br /> <br />(b) 'ZONING AMENDMENT ORDINANCE Z 79-3" <br /> <br /> On motion of Mr. GraF and seconded by Mr. Holley, the ordinance was adopted, and by the <br />following vote: <br /> <br />Ayes: Elliott, Gray, Holley, Oast, Davis <br />Nays: None <br /> <br /> 79-34 - On, motion of Mr. Oast and seconded by <br />on first reading at the Public Hearing of February <br />vote: <br /> <br />Mr. Gray, the following resolution gpproved <br />12, 1979, was adopted and by the following <br /> <br />(c) "A RESOLUTION GRANTING A USE PER~IIT TO CENTENNIAL BAPTIST CHURCH TO OPERATE <br /> A DAY CARE NURSERY NEAR THE INTERSECTION OF LINCOLN STREET AND ATLANTA AVENUE. <br /> <br /> WHEREAS, Centennial Baptist Church by Dr. E. Curtis Alexander, Administrator, made an <br />application pursuant to Section 40-78(b) of the Code of the City of Portsmouth, Virginia, <br />19F3, for the gzanting of a use permit as here-inafter described; and <br /> <br /> WHEREAS, ,the applicant and the Planning Director have done all things required to be <br />done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit hereinafter is sought: <br /> <br /> (a) Wil~n6~iad~er~aely affect the health and safety of persons residing or working <br />in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; and <br /> <br />(c) Wil~ ~e in accord with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. Centenn~ai Baptist Church by Dr. E. Curtis Alexander, Administrator, is hereby <br />granted a use permit pursuant to Section 40-78(b) of the~C~ty Code to operate a day care <br />nursery at the property described as follows: <br /> <br /> Beginning at the southwest corner of Lincoln Street and Atlanta <br /> Avenue; thence south along the west right-of-way of Atlanta Avenue, <br /> approximately 130'; thence west 1OO'; thence north approximately 20'; thence <br /> west approximately 35'; thence north approximately 105' to the south right- <br />of~-.wa~o£ Lincoln Street; thence east along said right-of-way approximately <br /> 140~.to Atlantic Avenue, the Point of Origin. <br /> <br />3. This use permit is approved subject to the following conditions: <br /> <br /> (a) That a day care nursery may be operated for up to forty (40) children under <br />six (6) years of age. <br /> <br /> (b) That Petitioner shall comply with all statutes, ordinances and policies <br />federal, state and local government that may be applicable." <br /> <br />Ayes: Elliott, Gray, Holley, Oast, Davis <br />Nays: None <br /> <br /> 79-34 - On motion of Mr. <br />approved on first reading at <br />the following vote: <br /> <br />Holley and seconded by Mr. Gray, <br />the Public Hearing of February 12, <br /> <br />the following resolution <br /> 1979, was adopted and by <br /> <br /> <br />
