Au,qust 24, 1999 <br /> <br />99-188(c): <br /> <br />"RESOLUTION GRANTING A USE PERMIT TO OZELLA SCOTT TO OPERATE A <br />RESTAURANT AND TWO APARTMENT UNITS AT 700 HIGH STREET. <br /> <br /> WHEREAS, Ozella Scott has made application pursuant to Section 40-43.1 of <br />the Code of the City of Portsmouth, Virginia (1988), for a use permit to operate a <br />restaurant and two apartment units at 700 High Street, Portsmouth, Virginia; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of the <br />application for an amended use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons <br />residing or working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the <br />property or improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure <br />compatibility with surrounding uses; and <br /> <br /> (d) Will be a project that will be developed according to a plan <br />for parking, driveways, and curb cuts which will provide for safe and convenient <br />traffic movement; and <br /> <br /> (e) Will be in accordance with the purposes of the City of <br />Portsmouth Zoning Ordinance. <br /> <br /> 2. That Ozella Scott is hereby granted a use permit pursuant to Section <br />40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of <br />a restaurant and two apartment units on property located at 700 High Street, and <br />being more particularly described as: <br /> <br />UP-99-12 <br /> <br />Beginning at the northwestern intersection of High Street and Green Street thence <br />north approximately 63 feet along the western right-of-way line of Green Street to a <br />point; thence west approximately 35 feet to a point; thence south approximately 63 feet <br />to a point; thence east approximately 35 feet along the northern right-of-way line of <br />High Street to the point of beginning. <br /> <br />3. That this use permit is approved subject to the following conditions: <br /> <br /> (a) The seating capacity of the restaurant shall be limited to no <br />more than 72 seats. <br /> <br /> (b) The hours of operation of the restaurant shall be limited to the <br />hours of 11:00 a.m. to 10:00 p.m. daily. <br /> <br /> (c) All exterior renovations and signage must be approved by the <br />Downtown Design Committee prior to construction. <br /> <br /> (d) The apartment conversions on the second and third floors shall <br />be in accordance with the submitted floor plans identified as Exhibit A, attached <br />hereto and made a part hereof. The Director of Community Quality and Planning <br />Services may approve minor modifications to the floor plans. <br /> <br /> (e) The applicant shall obtain a parking exception from the city prior <br />to obtaining any occupancy permit. <br /> <br /> <br />
