24Z <br /> <br />June 26? 1979 <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> (1) That the use for which the use permit hereinafter is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working <br />the neighborhood of the prcposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to property or improvemen <br />in the neighborhood; and <br /> <br />(c) Will be in accord with the purposes of the Zoning Chapter of the City Code. <br /> <br /> (2) The Salvation Army is hereby granted <br />the Cod~ of the City of Portsmouth, Virginia, <br />described as follows: <br /> <br />a use permit pursuant to Section 40-71[b) of <br />to operate a House of Worship at the property <br /> <br /> Beginning on the south side of Western Branch Boulevard~ 60 feet east <br />of its intersection with Halifax Avenue; thence east 60 feet along Western <br />Branch Boulevard; thence south to the north right-of-way of King Street; <br />thence west 60 feet; thence north to the south right-of-way of Western Branch <br />Boulevard, the Point of Origin. <br /> <br /> (3) This use permit is approved subject to <br /> <br /> Incorporated herein, is a letter from Home <br />adjoining property may be used by the Salvation <br /> <br />the following condition: <br /> <br />Federal Savings And Loan Association, whose <br />Army for parking." <br /> <br />Ayes: Barnes, Ear]y, Elliott, Gray, Holley, Oast, Davis <br />Nays: None <br /> <br /> 79-201 - The following ordinance approved on first reading at the Public Hearingrof <br />June 4, 1979, was taken up and read: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, <br />BY AMENDING SECTION 40-56(2) THEREOF, PERTAINING TO RBSIDENTIAI PARKING DISTRICTS." <br /> <br /> On motion of Mr. Early and seconded by Mr. Oast, the ordinance was adopted, and by the <br />following ~ote: <br /> <br />Ayes: Barnes, Early, Elliott, Gray, Holley, Oast, Davis <br />Nays: None <br /> <br /> 79-201 The following ordinance approved on first reading at the Public Hearing of <br />June 4, 1979, was taken up and read: <br /> <br />(g) "AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY <br /> AMENDING SECTION ~0-4814) RELATING TO DIMENSIONAL REQUIREMENTS FOR DRIVEWAYS <br /> AND PARKING LOTS." <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Holley, the ordinance was <br />the following vote: <br /> <br /> Ayes: Barnes, Early, Elliott, Gray, Holley, Oast, Davis <br /> Nays: None <br /> <br />adopted, and by <br /> <br />was <br /> <br /> Mayor Davis relinquished the Chair to Vice Mayor Holley for the following Item. <br /> <br />79-20I The following ordinance postponed from the Public Hearing of June 4, 1979, <br />taken up and read: <br /> <br />"AN ORDINANCE TO AMEND THE <br />ARTICLE V.I to CHAPTER 40, <br />DOWNTOWN DISTRICT D-I." <br /> <br />CODE OF THE CITY OF PORTSMOUTH, 1973, BY ADDING <br />PERTAINING TO A NEW ZONING DISTRICT DESIGNATED <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Oast, the ordinance was approved on first <br />reading, and by unanimous vo~e.
