25Z <br /> <br />July 10, 1979 <br /> <br /> Report - <br /> <br /> "As per your direction and per the City Manager's direction to you, I met with members <br />of the Fire-Police Pension Committee. I find that there is no misunderstanding on the part <br />of the committee, but rather a matter of disagreement. I will be glad to discuss the p6ints <br />of contention with and/or Mr. Williams. However, I will point them out in this report. <br /> <br /> 1. Sec. 31-14 - there is no objection to expanding the Board by adding two more non-city I <br /> employees. They object and will strongly oppose the two ex-officio members. It is <br /> feeling of the Committee that this is a move on the part of management to influence <br /> and dominate the Board. They also see it as a means of placing restrictions on the <br /> Board's authority to administer the Retirement system. <br /> <br />o <br /> <br />They object to Mr. Hollett handling certain matters pertaining to the Retirement <br />System. Also, to some of the reports, comments, and letters written by him as well <br />as position taken by him before the Board on retirements and retirement matters. <br /> <br />Sec. 31-70 they oppose to the wording in (c) that only allows retirement allowance <br />to widow or widower of an employee who has become eligible for service retirement. <br />Yet on the other hand (b) for those who die before obtaining the required years for <br />retirement are allowed to have allowance paid to: <br /> <br />a. Widow or widower during widowhood. <br />b. Child or children under age 18. <br />c. Dependent mother or f~ther. <br />d. Dependent sister or brother. <br /> <br />It is also felt that something should be in writing te cover an employee that has the <br />time and~selects an option (which in some cases'could be age 46), then at'a later <br />date becomes divorced. <br /> <br />The committee objects to the fact that they have no impnt~on the member appointed to <br />represent them on the Board. They request that the department, from which the member <br />is to be selected, be allowed no submit five names and one of them be appointed. <br /> <br />5. They object to one-term limitation for the Fire-Police representative. It is their :~ <br /> feeling that it is not enough time to do a good job. <br /> <br />They want to be notified of all pension changes. It is their request that a copy of <br />the ordinance, causing the change, be given to them 30 days before it goes to Council. <br />This is so they can have ample time to study the change. <br /> <br />They are upset because Sec. 31-156 (c) which allowed 100 percent joint and last sur- <br />vivor option was changed without their being advised of the change or without a meet <br />and c6nfer. <br /> <br />8. It is felt that when meet and confer sessions are held, with regard to the Retirement <br /> System, members of the Board should be present. <br /> <br />o <br /> <br />That no action be taken on the proposed amendments mntil the information contained <br />herein is presented to the Retirement Board. It is their wish that the Board discuss <br />these it'ems and give than a report. <br /> <br /> These are the highlights of their objections. As I said at the beginning they understand <br />the proposed amendments, but object to some of them. <br /> <br /> Members present at the meeting held on July 5, 1979 were D. R. Wells, Gary O'Dell, and <br />Gary Waters. Jerry Myers from the Police Committee was non present. Richard Wood from the <br />Pension Board was unable to attend." Signed by Wm. E. Kube, Battalion Chief. <br /> <br />Motion of Mr. Oast and seconded by Mr. Early, to adopt Ordinance 79-213 (B). <br /> <br /> Motion of Mr. Early and seconded by Mr. Gray, to amend the ordinance to accept nominations <br />frQm those departments who would like to have representation, and was adopted by unanimous vote <br /> <br />On motion, the following ordinance was adopted as amended, and by the following vote: <br /> <br />(B) <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, BY D~ENDING <br />SECTrgN 31-14, THEREOF, PERTAINING TO COMPOSITION; ~PPOINTMENT, TERM, SUSPENSION <br />OR REMOVAL AND COMPENSATION OF MEMBERS; VACANCIES FOR RETIREMENT BOARD." <br /> <br />Ayes: Barnes, Beamer, Early, Gray, Holley, Oast, Davis <br />Nays: None <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Holley, the following ordinance was adoFted, <br />and by the following vote: <br /> <br />(C) "AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA BY AMENDING <br /> SECTION 31-70 THEREOF, PERTAINING TO ORDINARY DEATH BENEFITS." <br /> <br />Ayes: Barnes, Beamer, Ea~y, Gray, Holley, Oast, Davis <br />Nays: None <br /> <br /> <br />
