2'51 <br /> <br />July 10, 1979 <br /> <br />At a regular meeting of the .City Council held on July 10, 1979, there were present: <br /> <br />Richard J. Davis, Jack P. Barnes, Ben A. Beamer, Sr., E. Saunders Early, Jr., <br />J. Robert Gray, James W. Holley, III, Edward L. 'Oast, Jr., Robert T. Williams, <br />City Manager, Steven Lieberman, Assistant City Attorney. <br /> <br /> Rev. Thomas J. Powers, Pastor, Park View Baptist Church, offered prayer, followed by <br />the Pledge of Allegiance to the Flag. <br /> <br />Mayor Davis welcomed all visitors in attendance. <br /> <br /> Motion of Mr. Gray and seconded by Mr. Oast, the minutes of the called meeting of June <br />26, 1979; minutes of the regular meeting of June 26, 1979, to be approved as received, and <br />was adopted by unanimous vote. <br /> <br />UNFINISHED BUSINESS <br /> <br />June <br /> <br />Mayor Davis relinquished the Chair to Vice Mayor Holley for the following Items: <br /> <br />79-201 - The ~ollowing ordinance approved on first reading at the regular meeting <br />26, 1979, was taken up and read: <br /> <br />of <br /> <br />(h) <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, 1973, BY ADDING <br />ARTICLE V.I TD CHAPTER 40, PERTAINING TO A NEW ZONING DISTRICT DESIGNATED <br />DOWNTOWN DISTRICT D-i." <br /> <br />Motion of Mr. Gray and seconded by Mr. Barnes, the o~dinance to be adopted. <br /> <br /> Motion of Mr. Barnes and seconded by Mr. Early, the ordinance to be amended to take <br />effect immediately, and was adopted by unanimous vote. <br /> <br />On motion, the ordinance was adopted as amended, and by the following vote: <br /> <br />Ayes: Barnes, Beamer, Early, Gray, Holley, Oast <br />Nays: None <br /> <br /> 79-201 The following ~ning petition,~ deferred from the Public Hearing of <br />June 4, 1979, was taken up and read: <br /> <br />(i) ~oni~g Petition Z 79-12 - Petition to rezone new Downtown D-1 Zoning District. <br /> <br /> On motion of Mr. Gray and seconded by Mr. Early, the following ordinance was approved <br />on first reading, and by unanimous vote: <br /> <br />"ZONING AMENDMENT ORDINANCE Z 79-12" <br /> <br />Mayor Davis resumed the Chair for the remainder of the meeting. <br /> <br /> 78-427 - The following ordinance approved on first reading at the regular meeting of <br />June 26, 1979, was taken up and read: <br /> <br />(c) "ZONING AMENDMENT ORDINANCE 2 78-22" <br /> <br /> On motion of Mr. Holley and seconded by Mr. Early, the ordinance was adopted, and by the <br />following vote: <br /> <br />Ayes: Barnes, Beamer, Early, Holley <br />Nays: Gray, Oast, Davis <br /> <br /> 79-213 The following ordinances deferred from the regular meeting of June 26, 1979, <br />were taken up and read: <br /> <br />(B) <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, BY AMENDING <br />SECTION 31-14, THEREOF, PERTAINING TO COMPOSITION; APPOINTMENT, TERM, SUSPENSION <br />OR REMOVAL AND COMPENSATION OF MEMBERS; VACANCIES FOR RETIREMENT BOARDi" <br /> <br />(c) <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA BY AMENDING <br />SECTION 31-?0 THEREOF, PERTAINING TO ORDINARY DEATH BENEFITS." <br /> <br />(D) <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA BY AMENDING <br />SECTION 31-156 THEREOF, PERTAINING TO ORDINARY DEATH BENEFITS." <br /> <br /> Gary O'Dell, 2020 .Greenwood Drive, representing the Fire/Police Retirement Committee, <br />spoke regarding to the understanding of B & D .and requested that they be delayed until a <br />complete report hah be fur~ished as previously requested. <br /> <br /> The Ci{y Manager presented t~e following letter: <br /> <br /> "Enclosed is a copy of a report received from Fire Chief Odell Benton reporting on the <br />meeting with the pension:::committee of the Fire a~d Police Department. <br /> <br /> This meeting was held at my request based on your direction at the last city council <br />meeting concerning the proposed changes of the retirement ordinances. Chief Kube was <br />selected Since he is a member of the Portsmouth Retirement Board and has longer service as <br />member of that board than any other person currently employed by the City." <br /> <br /> <br />
