<br />At a regular meeting of the City Council held on August 28, 1979, there were present:
<br />
<br />Richard J. Davis, Jack P. Barnes, Ben A. Beamer, Sr., E. Saunders Early, Jr.,
<br />J. Robert Gray, James W. Holley, III, Edward L. Oast, Jr., Robert T. Williams,
<br />City Manager, Gordon B. Tayloe, Jr., City Attorney.

<br /> Rev. C. C. Jenkins, Pastor, First Baptist Church, opened the meeting with prayer, followec
<br />by the Pledge of Allegiance to the Flag.
<br />
<br />Mayor Davis welcomed all visitors in attendance.
<br />
<br /> Motion of Mr. Beamer and seconded by Mr. Early, minutes of the Phblic Hearing of August
<br />13, 1979; minutes of the regular meeting of August 14, 1979, to be approved as received, and
<br />was adopted by unanimous vote.

<br /> 79-290 The following ordinance approved on first reading at the Public Hearing of
<br />August 13, 1979, was taken up and read:
<br />

<br /> On motion of Mr. Gray and seconded by Mr. Early, the ordinance was adopted, and by the
<br />following vote:

<br />13, 1979, was adopted, and by the

<br />"A RESOLUTION GRANTING A USE PERMIT TO JOHN R. SAVAGE, MINISTER, TO OPERATE A
<br />HOUSE OF WORSHIP AT OR NEAR THE INTERSECTION OF RAPIDAN STREET AND GREENWOOD
<br />DRIVE.
<br />
<br /> WHEREAS, George T. McLean Company, Inc., by John R. Savage, Minister, made an application
<br />pursuant to Section 40-71(b), Code of the City of Portsmouth, 1973, for the granting of a
<br />use permit as hereinafter-described; and
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things required to be
<br />done in connection with said application; and
<br />
<br />WHEREAS, the Planning Commission has recommended the granting of said use permit.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City'of Portsmouth, Virginia:
<br />
<br />(1) That the use for which the use permit hereinafter-described is sought:
<br />
<br /> (a) Will not adversely affect the health and safety of persons residing and
<br />working in the neighborhood of the proposed use;
<br />
<br /> (b) Will not be detrimental to the public use or injurious to property improvements
<br />in the neighborhood; and
<br />
<br />(c) Will be in accord with the purposes of the Zoning Chapter of the City Code.
<br />
<br /> (2) That George T. McLean Company, Inc. by John R.
<br />a use permit pursuant to Section 40-71(b) of the Code of
<br />operate a House of Worship on property described herein,
<br />in paragraph numbered (3) of this ordinance.
<br />
<br />Savage, Minister, is hereby granted
<br />the City of Portsmouth, 1973, to
<br />subject to the conditions set forth
<br />
<br /> Beginning on the east side of Rapidan Street 334.18 feet north of
<br />its intersection with Greenwood Dr~ve; thence east 150 feet; thence
<br />north 191.49 feet; thence west 150 feet to the east right-of-way of
<br />RRp~dR~ Street; thence south along said right-of-way 197.50 feet to the
<br />point of origin.
<br />
<br />(3) This ~ye permit is approved subject to the following condition:
<br />
<br /> That all public improvements required by the City of Portsmouth shall be constructed
<br />prior to use of the property as a place of worship."
