September 28, 1999 <br /> <br /> At a Regular Meeting of the City Council on Tuesday, September 28, 1999, <br />there were present: <br /> <br />Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, P. <br />Ward Robinett, Jr., J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., City Manager Ronald W. Massie, City Attorney G. Timothy Oksman. <br /> <br /> Councilman Cameron C. Pitts opened the meeting with prayer, which was <br />followed by the Pledge of Allegiance to the Flag. <br /> <br />Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to approve the minutes of a <br />Called Meeting on September 14, 1999, and a Regular Meeting on September 14, <br />1999, and was adopted by unanimous vote. <br /> <br />99 - 214 - Presentation: <br /> <br />Proclamation presented to Fire Chief Hugh Osborne for "Fire Prevention Week." <br /> <br />- Public Hearing - <br /> <br />99 - 215 - Public hearing on the issuance of up to $5,950,764 in General Obligation <br />Bonds to finance the public school building renovation, rehabilitation and repair, and <br />public school equipment acquisition projects constituting a portion of the City's Long- <br />Term Capital Improvement Program for the Portsmouth Public Schools. <br /> <br />1. Mark Geduldig-Yatrofsky, 363 Middle Street, spoke in support of additional funding <br />for the schools. <br /> <br />99 - 216 - Public hearing on proposed ordinance to appropriate $2,657,045 for fiscal <br />year 2000 from the City General Fund for increased funding to the School Operating <br />Budget and School Capital Improvement Program and to appropriate $1,328,522 in the <br />School Operating Budget. <br /> <br />There were no speakers. <br /> <br />- Unfinished Business - <br /> <br />Consent Aqenda <br /> <br />99 - 203 - Use permit and a code amendment application: <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Whitehurst, to adopt the following <br />ordinance and resolution, and was adopted by the following vote: <br /> <br />99-203(a): <br /> <br />"AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY ENACTING NEW SECTIONS 40-61.2.1, 40- <br />62.1.2 AND 40-61.2.3 THERETO PERTAINING TO THE CREATION OF LOCALIZED <br />ALTERNATIVE SIGN OVERLAY DISTRICTS." <br /> <br />99-203(b): <br /> <br />"RESOLUTION GRANTING A USE PERMIT TO THEODORE AND SANDRA <br />PINNOCK FOR THE OPERATION OF A CHILD DAY CARE FACILITY ON LOT 3A, <br />SECTION 13 ON CAVALIER BOULEVARD. <br /> <br /> WHEREAS, the Theodore and Sandra Pinnock have made application <br />pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988), for a <br />use permit to operate a child day care facility on Lot 3A, Section 13 on Cavalier <br />Boulevard, Portsmouth, Virginia; and <br /> <br /> WHEREAS, the applicants and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> <br />
