September 28, 1999 At a Regular Meeting of the City Council on Tuesday, September 28, 1999, there were present: Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, P. Ward Robinett, Jr., J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., City Manager Ronald W. Massie, City Attorney G. Timothy Oksman. Councilman Cameron C. Pitts opened the meeting with prayer, which was followed by the Pledge of Allegiance to the Flag. Mayor Holley called the meeting to order and welcomed all in attendance. Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to approve the minutes of a Called Meeting on September 14, 1999, and a Regular Meeting on September 14, 1999, and was adopted by unanimous vote. 99 - 214 - Presentation: Proclamation presented to Fire Chief Hugh Osborne for "Fire Prevention Week." - Public Hearing - 99 - 215 - Public hearing on the issuance of up to $5,950,764 in General Obligation Bonds to finance the public school building renovation, rehabilitation and repair, and public school equipment acquisition projects constituting a portion of the City's Long- Term Capital Improvement Program for the Portsmouth Public Schools. 1. Mark Geduldig-Yatrofsky, 363 Middle Street, spoke in support of additional funding for the schools. 99 - 216 - Public hearing on proposed ordinance to appropriate $2,657,045 for fiscal year 2000 from the City General Fund for increased funding to the School Operating Budget and School Capital Improvement Program and to appropriate $1,328,522 in the School Operating Budget. There were no speakers. - Unfinished Business - Consent Aqenda 99 - 203 - Use permit and a code amendment application: Motion by Mr. Benn, and seconded by Mr. Whitehurst, to adopt the following ordinance and resolution, and was adopted by the following vote: 99-203(a): "AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988) BY ENACTING NEW SECTIONS 40-61.2.1, 40- 62.1.2 AND 40-61.2.3 THERETO PERTAINING TO THE CREATION OF LOCALIZED ALTERNATIVE SIGN OVERLAY DISTRICTS." 99-203(b): "RESOLUTION GRANTING A USE PERMIT TO THEODORE AND SANDRA PINNOCK FOR THE OPERATION OF A CHILD DAY CARE FACILITY ON LOT 3A, SECTION 13 ON CAVALIER BOULEVARD. WHEREAS, the Theodore and Sandra Pinnock have made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988), for a use permit to operate a child day care facility on Lot 3A, Section 13 on Cavalier Boulevard, Portsmouth, Virginia; and WHEREAS, the applicants and the Planning Director have done all things required to be done in connection with said application; and
