January 22, 1980 <br /> <br />to acquire, construct, reconstrucT, equip, improve, extend, enlarge, maintain, repair and <br />operate olaf-street parking facilities within t~he corporate limits of the City of Portsmouth a <br />to provide the imposition and collection of rates, rentals, fees and charges for the use of <br />and for the services furnished by such parking facilities. Th~ authority consist of five (5) <br />members appointed by the City Council. <br /> <br /> Section 6(h) of the enabling legislation authorizes and empowers the Authority to fix an <br />revise from time to time and to charge and collect rates, rentals, fees and other charges for <br />the services and facilities furnished by such parking facilities and to establish and revise <br />from time to time regulations in respect of the use, operation and occupancy of such parking <br />facilities or part thereof. <br /> <br /> 'S~tio~..8 of the legislation provides that the rates, rentals, fees and charges for the <br />use of the services and facilities furnished at the parking facilities or parts thereof, shall <br />not be subject to supervision or regulation by any bureau, board, commission or other agency <br />of the Commonwealth, or of any political subdivision. The rates, rentals, fees and other <br />charges are fixed and revised so that the revemues, together with any other available funds, <br />will be sufficient at all times to pay the cost of maintaining, repairing, and operating <br />the parking facilities and to pay the principal of and the interest of any bonds issued by <br />the Authority that shall be due and payable and to provide reserves for such purposes. <br /> <br /> Accordingly, there does not appear to be any statutory requirements establishing the <br />method to be used by the Parking Authority to fix rates, rentals, fees and charges, nor any <br />Constitutional or statutory requirement for a public hearing prior to the fixing or revision <br />of same. It would, therefore, be the opinion of this office that the method established by <br />the Parking Authority to review t~e establishment or revision of such rates are subject only <br />to their internal regulations and/or by-laws." <br /> <br />No action taken. <br /> <br /> 79-442(k) - The following ordinance deferred on final reading at the regulrar meeting <br />of January 8, 1980, was taken up and read: <br /> <br />"AN 3RDINANCE TO AMEND THE CODE OF THE CITY OF ~ORTSMOUTH, VIRGINIA, BY AMENDING <br />SEETION 40-139(a), '(4), PERTAINING TO WATERFRONT W-1 DISTRICT OFF-STREET AUTOMOBILE <br />PARKING." <br /> <br />the <br /> <br />On motion of Mr. Early and seconded by Mr. B~rnes, the ordinance was <br />~ollowing vote: <br /> <br /> Ayes: Barnes, Beamer, Early, Gray, Holley, Oast, Davis <br /> Nays: None <br /> <br />adopted, and by <br /> <br /> The following reports from the City Manager were presented: <br /> <br /> 80-32 -~"Consideration of an ordinance to amend the City Code of the City of Portsmouth, <br />Virginia, 1973, by amending Chapter 2, Article XVIII, establishing the Jail Advisory Board. <br /> <br /> This ordinance establishes an Advisory Board to be known as the Jail Advisory Board of <br />the City of Portsmouth; consisting of - members appointed by City Council. The members of <br />the Board shall be appointed for terms of ~ years; however, the first appointees will be <br />appointed for staggered terms in order to implement an orderly rotation. This ordinance <br />sets forth th~ methodslof~appointment, election of officers, meetings, and powers and duties <br />of the Board. ~The es~tablishment of the Jail Advisory Board was recommended by the Grand Jury <br />after an exhaustive study of the Portsmouth City Jail. The City Manager recommends adoption.~ <br /> <br /> On motion of Mr. Beamer and seconded by Mr. Early, the following ordinance was adopted <br />on first and final reading, and by the following vote: <br /> <br /> "AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY ADDING <br /> %~A~HAPTER 2 THEREOF, ARTICLE XVIII ESTABLISHING THE JAIL ADVISORY BOARD." <br /> <br />Ayes: Barnes, Beamer, F~rly, Gray, Holley, Oast, Davis <br />Nays: None <br /> <br /> 80-33 "Consideration of an o~dinance on first reading to appropriate $10,000 from the <br />~Capital Improvements Fund for upgrading sports lighting at Douglas Park. <br /> <br /> The 1979-80 Capital Improvements Program includes $25,000 for upgrading of sports light- <br />ing and improvements at Douglas Park. This ordinance appropriates $10,000 of this alloca- <br />tion fom. the ,upgrading of the sports lighting which includes the replacement of existing <br />lights with metal halide.
