<br />At a regular meeting of the City Council held on February 26, 1980, there were present:

<br />Richard J. Davis, Jack P. Barnes, Ben A. Beamer, Sr., E. Saunders Early, Jr.,
<br />J. Robert Gray, James W. Holley, III, Edward L. Oast, Jr., Robert T. Williams,
<br />City Manager, Steven Lieberman, City Attorney.
<br />
<br /> Dr. Thomas J. Powers, Pastor, Park View Baptist Church, opened the meeting with prayer,
<br />followed by the Pledge of Allegiance to the Flag.
<br />
<br />Mayor Davis welcomed all visitors in attendance.
<br />

<br />"A RESOLUTION GRANTING A USE PERMIT TO THE PORTSMOUTH CHURCH OF THE LORD JESUS
<br />CHRIST OF THE APOSTOLIC FAITH TO OPERATE A HOUSE OF WORSHIP AT 615 CHESTNUT
<br />STREET.
<br />
<br /> WHEREAS, GraceMorlino, by Nathan Thomas, Minister, made
<br />Section 40-71(b) of the Code of the City of Portsmouth, 1973,
<br />of a use permit as hereinafter-described; and
<br />
<br />an application pursuant to
<br />as amended, for the granting
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things required to be
<br />done in connection with said application; and
<br />
<br />WHEREAS, the Planning Commission has recommended the granting of said use permit.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia;
<br />
<br />(1) That the use for which the use permit hereinafter-described is sought:
<br />
<br /> (a) Will not adversely affect the health and safety of persons residing and working
<br />in the neighborhood of the proposed use;
<br />
<br /> (b) Will not be detrimental to the public ~se or injurious to the propDrty or
<br />improvements in the neighborhood; and
<br />
<br />(c) Will be in accord with the purposes of the Zoning Chapter of the City Code.
<br />
<br /> (2) That Grace Morlino, by Nathan Thomas, Minister, on behalf of the Portsmouth
<br />Church Of The Lord Jesus Ch~is~t~f The Apostolic Faith is hereby granted a use permit pursuant
<br />to S~ction 40-71(b) of the Code of the City of Portsmouth, 1973, to operate a house of
<br />worship on property described herein subject to conditions set forth in paragraph (3) of
<br />this ordinance.
<br />
<br /> Beginning on the east side of Chestnut Street approximately 60 feet
<br />north of its intersmction with County Street; thence east approximately
<br />50 feet; thence north approximately 25 feet; thence west approximately
<br />50 feet; thence south approximately 25 feet to the point of origin; also
<br />known as 615 Chestnut Street.
<br />
<br />(3) This use permit is approved subject to the following conditions:
<br />
<br /> (1) That all public improvements required by the City of Portsmouth shall be
<br />constructed prior to the use of property as a place of worship.
<br />
<br /> (2) That the applicant comply with Section 40-47 of the Code of the City of
<br />Portsmouth, 1973, as amended, with regard to remo~e parking lots and incorporated herein
<br />an instrument duly executed and acknowledged on behalf of Volksorf TV-Stereo Center, Inc.
<br />whose adjoining property is to be used for parking in accordance with the applicable
<br />sections of the Zoning Chapter of the City Code and which is to be recorded in the office
<br />of the Clerk of the Circuit Court of ~he City of Portsmouth.
<br />
<br /> (3) That the use permit would be considered to be revoked unless building permits
<br />are issued and the authorized operation under way within one (1) year.
<br />
<br /> (4) That the use permit would be issued to Nathan Thomas as Minister of the
<br />Portsmouth Church Of The Lord Jesus Christ of the Apostolic Faith and to cover such activities
<br />at the premises named and would not be transferable to any other person or church or to any
<br />other premises or to any new structure erected on the premises and that any transfer of any
<br />such use permit must be recommended by the Planning Commission and approved by the City
<br />Council."
