<br /> WHEREAS, the Virginia Commission of Outdoor Recreation provides funds to assist politica
<br />subdivisions of the State of Virginia in developing open space and park lands; an~
<br />
<br /> WHEREAS, there are urgent needs within the City of Portsmouth to develop park land and
<br />accomplish needed conservation work; and
<br />
<br /> WHEREAS, there are urgent needs within the City of
<br />young adults and the current unemployment rate is 5.8%

<br /> WHEREAS, park development is deemed of high improvement and development priority by the
<br />Council of the City of Portsmouth; and

<br />WHEREAS, the project is~ funded up to 100% by the Virginia Commission of Outdoor Recreati
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the City Manager is hereby authorized to cause such information or materials as may be necess~
<br />to be provided to the appropriate State agency and to enter into such agreements as may be
<br />necessary to permit the formulation, approval and funding of the Park Development Project.
<br />
<br /> AND BE IT FURTHER RESOLVED that the Council of the City of Portsmouth gives its assuranc~
<br />that the General Provisions of the Young Adult Conservation Corps and the Virginia Young Adul'
<br />Conservation Corps Fiscal Procedures will be complied with in the administration of this
<br />project;
<br />
<br /> AND BE IT FURTHER RESCLVED that the Council of the City of Portsmouth g~ves its assuranc,
<br />that all other applicable State and Federal regulations governing such expenditure of funds
<br />provided by Virginia Commission of Outdoor Recreation will be complied with in the administra
<br />tion of this project;
<br />
<br /> AND, ALSO., BE 1% FURTHER RESOLVED that the United States Department of Agriculture and
<br />Interior and the Commission of Outdoor Recreation are respectfully requested to assist in the
<br />prompt approval and funding of the Park Development Project in order to enhance the standard
<br />enjoyment for all our citizenry."

<br /> 80-194 "Consideration of a resolution authorizing the City Manager to convey an ease-
<br />ment on City owned property to the City of Suffolk near Lake Kilby Shores.
<br />
<br /> The City of Suffolk desires an easement for a sewer force main on certain City owned
<br />property in Suffolk near Lake Kilby. This force main will not be in conflict with the
<br />operation of public utility facilities; and, should benefit the watershed by having a public
<br />sewer system in the area rather than septic tanks. The City Manager recommends adoption of
<br />this resolution authorizing and granting this easement.
<br />
<br /> On motion of Mr. Beamer and seconded by Mr. Gray, the following resolution was adopted,
<br />~nd by the following vote:
<br />
<br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY AN EASEMENT ON CITY-
<br />OWNED PROPERTY TO THE CITY OF SUFFOLK, VIRGINIA (LAKE KILBY SHORES).
<br />
<br /> WHEREAS, the City of Suffolk desires to install a sewage force main over, under and
<br />across certain hereinafter-described property owned by the City of Portsmouth; and
<br />
<br /> WHEREAS, the installation of said sewage force main will not be in conflict with the
<br />operation of public utility facilities of the City of Portsmouth; and
<br />
<br /> WHEREAS, Section 2.09(c) of the Charter of the City of Portsmouth provides that the
<br />may convey property to the Commonwealth of Virginia or any political subdivision thereof,
<br />without advertisement and without receiving bids; and
<br />
<br />City

<br />WHEREAS, the City of Suffolk is a municipal corporation of the Commonwealth of Virginia.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the City Manabger be, and he hereby is, authorized to convey a free, perpetual and exclusive
<br />easement and right-of-way over, under and across the hereinafter-described property for the
<br />purpose of constructing, renewing and repairing a sewage force main.
<br />
<br /> All that certain piece or parcel of land situate in the City
<br />of Suffolk, Firginia, shown on that certain plat entitled, "Plat
<br />Showing Easement For City Of Suffolk Kilby Shores Force Main From
<br />City Of Portsmouth", dated January 30, 1980, prepared by Hassell
<br />& Folkes, P.C., Surveyors g Engineers, Portsmouth, Virginia,
<br />a copy of said plat being attached hereto for a more particular
<br />description.

<br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to complet,
<br />all transactions and execute all documents incident to such conveyance."
