July 8, 1980 <br /> <br />At a regular meeting of the City Council, held on July 8, 1980, there were present: <br /> <br />J. E. Johansen, Jack P. Barnes, Ben A. Beamer, Sr., J. Robert Gray, Edward L. Oast, Jr., <br />Gloria O. Webb, Morton V. Whitlow, Robert T. Williams, City Manager, Steven Lieberman, <br />City Attorney. <br /> <br /> Rev. Art Wingfield, Pastor, Broad Street Methodist Church, opened the meeting with prayer, <br />followed by the Pledge of Allegiance to the Flag. <br /> <br /> Mayor Johansen welcomed all visitors in attendance and expressed his belief that the <br />Council would work in a united and harmonious fashion for the best interest of the City. <br /> <br /> Motion of Mr. Gray and seconded by Mr. Beamer, the minu~es of the called meeting of <br />June 24, 1980; minutes of the regular meeting of June 24, 1980, to be approved as received, <br />and was adopted by unanimous vote. <br /> <br />80-232 Election of Vice Mayor Mayor Johansen asked for nominanions. <br /> <br />Mr. Barnes nominated Councilman Ben A. Beamer, Sr. <br /> <br />Upon motion made, nominatio~ns were closed by unanimous vote. <br /> <br />The following vote for Councilman Beamer as Vice Mayor was taken: <br /> <br />Ayes: Barnes, Beamer, Gray, Oast, Webb, Whitlow, Johansen <br />Nays: None <br /> <br />Councilman Beamer was elected for a term of two years as Vice Mayor. <br /> <br />UNFINISHED BUSINESS <br /> <br /> 80-164 GROUP HOUSING PROJECT GHP-80-2 <br />regular meeting of May 27, 1980. <br /> <br />River Shore Apartments, deferred from the <br /> <br />The following letter received from Alex T. Mayo, Jr., Attorney was presented: <br /> <br /> "On behalf of Virginia Urban Developers and Portsmouth Partners, I wish to withdraw <br />the group housing project proposal presently under consideration by the City Council for the <br />parcel owned by Portsmouth Partners at the northeast corner of Rivershore Road and Hedgerow <br />Lane. <br /> <br />Please let me know if any further action on our part is necessary." <br /> <br />The following report was received from the Director of Planning: <br /> <br /> "At its regular monthly meeting on June 3, 1980, the Planning Commission authorized <br />Chairman Laurence Howes to appoint a special subcommittee to investigate the legality and <br />propriety of action taken on August 7, 1979 granting preliminary subdivision approval to a <br />plat titled "PRELIMINARY SUBDIVISION OF RIVER SHORE, Section 3, Portsmouth, Virginia, Virginia <br />Urban Developers, 3330 Pacific Avenue, Virginia Beach...property owner, Portsmouth Partners <br />Inc., P. O. Box 3508, Norfolk, Virginia." This was in resp.onse to actions taken on May 27, <br />1980 by City Council which referred certain land use management decisions to the City Council <br />docket of July 8, 1980. The Subcommittee met Tuesday, June 10, 1980 to confer with the <br />Assistant City Manager for Plans and Development, the City Attorney, the City Engineer and <br />the Planning Director. ThE Subcommittee conducted additional research, contacted our Director <br />of Public Health and made a preliminary report to the Planning Commission during a field trip <br />conference on Tuesday, June 24, 1980. <br /> <br /> At its regular monthly meeting on July 1, 1980, the Planning Commission received, en- <br />dorsed and resolved unanimously to transmit to you for presentation to City Council the final <br />report of this Special Subcommittee. Findings include the following: (1) The preliminary <br />plat was properly presented and legally approved, (2) Off-site drainage adequacy is based on <br />fifty year storm frequency and utilization of a borrow pit lake on adjoining land owned by <br />Associated Churchland Investors. This lake has two outfalls to Hampton Roads, one at elevation <br />6.5 and one at 8.1 feet mean sea level, (3) This lake currently poses no special problem inso- <br />far as public health and safety are concerned, and (4) The City will through its Director of <br />Public Health monitor future urban development around the lake and act to preclude environment- <br />al problems." <br /> <br /> Robert W. Wentz, Jr., 4730 River Shore Road, spoke in favor of t~e withdrawal or'the <br />group housing project, but anticipated concern with the future use of the property if!not <br />rezoned and requeSted more formal requirements regarding the protection of the publiclfrom <br />problems associated with the burrow pit. <br /> <br /> Motion of Mrs. Webb and seconded by Mr. Whitlow, <br />Jr., Attorney, representing Virginia Urban Developers <br />was adopted, by unanimous vote. <br /> <br />to suspend ~he rules for Alex Ti Mayo, <br />and Portsmouth Partners, to spe&k and <br /> <br /> Mr. Mayo spoke regarding the withdrawal of the group housing project applicationland that <br />he hoped to come bahk to the Planning Commission and City Council with a different plan, but <br />what it max'be~ he could not state at this time. , <br /> <br /> Motion of Mr. Oast and seconded by Mr Barnes, the request from the Virginia Urba~ Develope <br />and Portsmouth Partners to withdraw group housing project proposal to be approved, and was <br />adopted by unanimous vote. ~ <br /> <br /> <br />
