<br /> 80-258 "Consideration of a resolution authorizing the City Manager to convey City-owned
<br />property located at 420 South Street and 518~520 South Street.

<br /> Bids were received for these properties, in accordance with the resolution of Council,
<br />from Claude M. Scaildone and James E. Walsh, Jr. For the property located at 420 South Stree~
<br />the bid was $1,200 for the purpose of using the property for offices under the guidelines of
<br />D-1 zoning or for residential use to compliment the properties now owned by the bidders
<br />at 426 South Street. The bid for S18-S20 South Street was $1,280 with the use being stated
<br />in conjunction with the property already Owned by the bidders at 522 South Street. Each of
<br />the bid amounts were the minimum amount required. The City Manager recommends adoption."

<br /> On motion of Mr. Barnes and seconded by Mr. Gray, the following resolution was adopted,

<br />AUTHORIZING THE CITY MANAGER TO ACCEPT THE BID OF CLAUDE M.
<br />JAMES E. WALSH, JR. TO PURCHASE CERTAIN CITY-0WNED PROPERTY
<br />SOUTH STREET); AUTHORIZING THE CITY MANAGER TO CONVEY.

<br /> WHEREAS, the CounciI of the City of Portsmoutk, Virginia, has determined that certain
<br />~roperty, hereinafter-described, is surplus property and no longer required by the City for
<br />mts purposes; and
<br />
<br /> WHEREAS, the Council has, by motion adopted July 8, 1980, authorized the City Manager to
<br />advertise this property for sale upon certain terms and conditions; and
<br />
<br /> WHEREAS, the City Manager has caused said property to be advertised in accordance with
<br />said motion; and
<br />
<br /> WHEREAS, Claude M. Scialdone and James E. Walsh, Jr. have submitted a bid in response to
<br />said advertisement to purchase 320 South Street for the sum of One Thousand, Two Hundred
<br />($1,200.) Dollars for the purpose of office or commercial development within the guidelines o~
<br />D-1 Zoning or residential to compliment the contiguous property at 425 South Street; and to
<br />purchase 518-520 South Street for the sum of One Thousand, Two Hundred Eighty ($1,280.) Dolla
<br />for the purpose of office or commercial development within the guidelines of D-I Zoning or
<br />residential in connection with contiguous property at S22 South Street; and
<br />
<br /> WHEREA.S, the City Councils finds, after due consideration, that the said bid complies
<br />ful.ly wi%~ the terms of the advertisement of said property and that the bid is the highest of
<br />all bids received and will permit disposition of the property on terms most favorable to plans
<br />for development of the area.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the bid of Claude M. Scialdone and James E. Walsh, Jr. to purchase property at 420 South
<br />Street, 518-520 South Street, Portsmouth, Virginia be, and the same hereby ms, accepted based
<br />on the conditions for use and deveIopment of said property as set forth in the bid.
<br />
<br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to execute
<br />all documents and complete all transactions incident to the conveyance of this property,
<br />subject to the terms and conditions set forth in said bid and in the advertisement for sale
<br />of this property by the City."

<br /> 80-259 "Consideration of a resolution expressing the Council's opposition to the
<br />proposed rate increase by C g P Telephone and directing the City Attorney to file a petition
<br />mn 'o~poB~ion and/or intervene zn the proceedings before the State Corporation Commission.
<br />
<br /> ~ased on our review of the proposed rate ~ncrease, C g P is doing a restructuring of the
<br />entire rate schedule as it applies to commercial phones. In our opinion the rate schedule
<br />increase which has been publicized relative to residential users ms excessive as it relates
<br />to commercial accounts and commercial phones. In reviewing the rate schedule it appears that
<br />many of the commercial accounts which includes the City, schools, PRHA, and other governmental
<br />agencies could experience a rate increase as high as 40 to 50% under the proposed schedule.
<br />Informatior furnished with their rate increase request indicates that the average increase per
<br />customer will be approximately 9%. The City Manager recommends adoption."
<br />
<br /> Charles E. Gwaltney, Manager, C ~ P Telephone Comoany, asked City Council to defer actio~
<br />until he had an opportunity to meet with the City Manager to discuss the impact of increased
<br />taxes on the rate-increase.

<br />Hodges Manor citizens regarding the rezoning in the Hodges Manor area: and what right does
<br />HUD have to take our~ocal authority to decide what happens inoour city holding up the
<br />funds is illegal, and if Portsmouth doesn't take action, Hodges Manor citizens may have to.
