<br />At a regular meeting of the City Council, held on August 12, 1980, there were present:

<br />J. E. Johansen, Jack P. Barnes, Ben A. Beamer, Sr., J. Robert Gray, Edward L.
<br />Oast, Jr., Gloria O. Webb, Morton V. Whitlow, Robert T. Williams, City Manager,
<br />Steven Lieberman, City Attorney.

<br /> Rev. G. Daniel Jones, Pastor Zion Baptist Church and President of the Portsmouth
<br />Ministerial Association, opened the meeting with prayer, followed by the Pledge of Allegiance
<br />to the Flag.
<br />
<br />Mayor Johansen weIcomed all visitors in attendance.
<br />
<br /> Motion of Mr. Gray and seconded by Mr. Whitlow, minutes of the called meeting of July
<br />22, 1980; minutes of the regular meeting of July 22, 1980, to be approved as received, and
<br />was adopted by unanimous vote.
<br />
<br /> Mayor Johansen presented to former Vice Mayor Jamas W. Holley, III, the following
<br />resolution:
<br />
<br /> "WHEREAS, James W. Holley, III has ser¥~d the City of Portsmouth as Councilman for the
<br />years 1968 through 1978; Vice Mayor from 1978 through 1980, and has demonstrated a dedicated
<br />interest in the problems and progress of this City; and
<br />
<br /> WHEREAS, his tenure as Vice Mayor and Councilman has been in the highest tradition of
<br />public service; and
<br />
<br /> WHEREAS, his leadership and devotion to the general welfare of
<br />has resulted in a period of growth and development and provided the
<br />progress.

<br /> Former ~{ayor Richard J'. Davis and former Councilman E. Saunders.Early, Jr., were unable
<br />be present to receive similar resolutions and will be presented to them at a later date.

<br />~'-~280-¢8 The following letter from Cox Cable of Portsmouth, Inc. was received:
<br />
<br /> "On behalf of Cox Cable of Portsmouth,Inc., this will notify you of the termination of
<br />the earlier proposed merger of Cox Broadcasting Corporation and General Electric Company.
<br />
<br /> Accordingly, the Council's approval of the earlier proposed merger has geen rendered
<br />moot. Cox Cable wishes to thank the Council for its consideration in this regard. Sig~ed
<br />by David P. Fleming, Council for Cox Cable of Portsmouth, Inc."
<br />
<br /> Motion of Mr. Gray and seconded by Mr. Barnes, the letter to be received as information,
<br />and was adopted by unanimous vote.
<br />
<br /> 80-206 On motion of Mr. Barnes and seconded by Mrs. Webb, the following resolution was
<br />adopted, and by the following vote:
<br />
<br />"A RESOLUTION DIRECTING THE PORTSMOUTH REDEVELOPMENT AND HOUSING AUTHORITY
<br />TO PREPARE AN AMENDMENT TO THE 1979 THREE-YEAR PLAN IN ACCORDANCE WITH
<br />THE REQUIREMENTS OF THE 1974 HOUSING AND COMMUNITY DEVELOPMENT ACT, AS AMENDED,
<br />AND TO SCHEDULE A PUBLIC HEARING ON SAID AMENDMENT FOR AUGUST 26, 1980.
<br />
<br /> WHEREAS, the Department of Housing and Urban Development (HUD) imposed conditions
<br />upon the City of Portsmouth's 1980 Community Development contract which required the City
<br />to provide for the deconcentration of low and moderate ~ncome housing; and
<br />
<br /> WHEREAS, the City has proceeded to attempt to satisfy the Regulations promulgated
<br />pursuant to the 1974 Housing and Community Development Act, as amended; and
<br />
<br /> WHEREAS, on June 10, 1980, the Council of the City of Portsmouth amended the 1980
<br />Community Development Program and Housing Assistance Plan to include substantial rehabilitati¢
<br />· n unimpacted census tracts in order to assure and increase safe, decent and sanitary housing
<br />· n the City of Portsmouth; and
<br />
<br /> WHEREAS, the amended contract forwarded by HUD on June 12, 1980, prohibited the City
<br />from Using substantial rehabilitation since it requires for the 1980 Community Development
<br />Program that the proposed units for such rehabilitation must be vacant and subject to a
<br />single contract authority; and
<br />
<br /> WHEREAS, the data prepared by PRHA and City Staff, have clearly indicated to the
<br />satisfaction of the Council, '~ty Manager, and the City's Attorneys that for 1980, the
<br />established needs of the City may be satisfied by the ~ eo~nstruction of 100 units in an
<br />unimpacted census tract; and
