i40 October 14, 1980 80-377 - On motion of Mr. Oast and seconded by Mrs. Webb, the following resolution was adopted, and by the following vote: "A RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY CITY-OWNED PROPERTY TO THE PORTSMOUTH REDEVELOPMENT AND HOUSING AUTHORITY (TRUXTON SECONDARY EDUCATION CENTER, TAX MAP 151, PARCELS 3, 27, 28~ 29, 32, 33, 34). WHEREAS, the City of Portsmouth owns certain property known as the Truxton Secondary Education Center which is no longer needed by the City and with the adjacent City-owned pro- perty is, therefore, declared to be surplus property; and WHEREAS, this property is within the Tru×ton WHEREAS, the assessed value of said property Forty Dollars (5701,940.); and Conservation Area; and is Seven Hundred One Thousand, Nine Hundred ' WHEREAS, ~he Portsmouth Redevelopment and Housing Authority desires to obtain title to said property for the purpose of negotiating the deVelopment thereof with a private developer; and WHEREAS, Section 2.09(c) of the Charter of the City of Portsmouth provides that the City may convey property to the Commonwealth of Virginia or any political subdivision thereof without'advertisement and without receiving bids; and WHEREAS, the Portsmouth Redevelopment and Housing Authority is a political subdivision of the Commonwealth of Virginia. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager be, and he hereby is, authorized to convey the prope~%y generally known as the Truxton Secondary Education Center and the a¢~acent City property which consists of approx mately 14.2 acres to the Portsmouth Redevelopment and Housing Anthority. The terms of this conveyance sh~ll be that the Portsmouth Redevelopment and Housing Authority will present to the City Manager a contract for the purchase of said property by a developer and a proposal for its use which are to be subject to the approval of the City Council. .. BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to complete all transagDions and execute all documents incident to such conveyance upon the condition stated herein; that the City Manager be, and he hereby is, authorized to permit access to said property prior to the transfer of title thereof for the purpose of soil borings and ¢estings to be completed by the perspective developers upon the condition that said developer shall agree to 'hold the City of Portsmouth harmless from any and all claims, damages, or causes of action which may result from the conduct of such testing by the developer or its agent."
