October 28, 1980 WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to property or improve- ments in the neighborhood; and (c) Will be in accord with the purposes of the 5oning Chapter of the City Code. 2. That Bethany Baptist Church, by the Rev. H. A. Hunderup, is hereby granted a use permit pursuant to ~¢0-7S(b) of the City Nursery-Kindergarten/Child Care Center at the property described Jr., Pastor and Principal, Code to operate a Day as follows: Beginning at the northwest intersection of Portsmouth Boulevard and Shea Street; thence northerly along the west side of Shea Street to the south right-of-way of Colin Drive, South; thence westerl) along said right-of-way 415.O2'; thence southerly 133.44'; thence westerly 60'; thence southerly 135' to the north right-of-way of Portsmouth Boulevard; thence easterly along said right-of-way to Shea Street, the Point of Origin. 3. This use permit is approved subject to the following conditions: (a) That the Day Nursery-Kindergarter/Child Care Center may be operated for up to thirty (30) children under the age of six (6) years of age. (b) That the petitioner shall comply with all statutes, ordinances, policies and regulatidns of federal, state and local governments that may be applicable and shall have obtained all necessary licenses and permits required for this use." Ballard, President, permit pursuant to Section 40-75Ib) of the City Code to operate a ial club on property hereinafter-described: is hereby private Beginning at the southeast corner of Portsmouth Boulevard and Grand Street; thence east along the south right-of-way of Portsmouth Boulevard 50'; thence south 119.76'; thence west 50' to the east right-of-way of Grand Street; thence north along said right-of-way 120.24' to Portsmouth Boulevard, the Point of Origin; the premises being designated as 3025 Portsmouth Boulevard. 3.
