January 13, 1981 <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO LEE~HOWARD PARTNERSHIP TO OPERATE MINI SELF- <br />STORAGE WAREHOUSES ON LAND LOCATED AT THE NORTHEAST CORNER OF YORKSHIRE ROAD AND <br />AIRLINE BOULEVARD. <br /> <br /> WHEREAS, Lee Howard Partnership, by Irvin Caplan, <br />pursuant to ¢40-71(b), Code of the City of Portsmouth, <br />of a use permit as hereinafter-described; and <br /> <br />Partner, has made an application <br />1970, as amended, for the granting <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be <br />done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit hereinafter-described is sought: <br /> <br /> (a) ~itl not adversely affect the health and safety of persons residing and workin~il <br />in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; and <br /> <br />(c) Will be in accord with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. That Lee Howard Partnership is hereby granted a use permit pursuant to 840-71(b), <br />Code of the City of Portsmouth, 1973, as amended, to operate mini self-storage warehouses <br />on property described herein subject to the conditions set forth in Paragraph 3. <br /> <br />UP-80-14 <br /> <br /> Beginning at the northeast corner of Yorkshire Road and Airline <br />Boulevard; thence easterly along the north right-of-way of Airline <br />Boulevard 770', more or less; thence northerly 312.38'; thence westerly <br />638.15'; thence northerly 144.02'; thence westerly 216.50'; thence <br />southerly llS'; thence southwesterly 60' to the east right-of-way of Yorkshire <br />R~ad~ thence southerly 355', more or less, to Airline Boulevard, the point <br />of origin. <br /> <br />3. The use permit is approved subject to the following condition: <br /> <br /> (1) Screening of the complex from the adjoining residential areas as provided in <br />840-44 is mandatory, and such screening must be approved in writing by the Director of <br />Planning." <br /> <br />Ayes: Barnes, Beamer, Gray, Oast, Webb, Whitlow, Johansen <br />Nays: None <br /> <br /> 80-438 - Ohemotion of Mr. Gray and seconded by Mr. Whitlow, the following resolution <br />approved on first reading at the Public Hearing of December g~ 1980, ~a~ adop%ed and by the <br />following vote: <br /> <br />(k) "A RESOLUTION GRANTING A USE PERMIT TO RONALD R. MITCHELL AND SANDRA H. MITCHELl <br /> TO OPERATE A DAY CARE CENTER NEAR THE NORTHWEST CORNER OF BROAD AND. HARTFORD <br /> STREETS. <br /> <br /> WHEREAS, Rcnald R. Mitchell and Sandra H. Mitchell made an application pursuant to <br />~40-78(b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use <br />permit as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be <br />done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1.
