216 <br /> <br />February 24~ 1981 <br /> <br /> On motion of Mr. Gray and seconded by Mrs. Webb, the ordinance was adopted for C-l- <br />Conditional, and by the~follo~ing vote: <br /> <br />Ayes: Barnes, <br />Nays: None <br />Abstaining: Whitlow <br /> <br />Gray, east, Webb, Johansen <br /> <br /> 81-45 The following ordinance approved on first reading at the Public Hearing of <br />February 9~ 1981, was taken up and read: <br /> <br />(e) "ZONING AMENDMENT ORDINANCE Z 80-1' <br /> <br /> On motion of Mr. Barnes and seconded by Mrs. Webb, the ordinance was adopted for Commer- <br />cial C-land by the following vote: <br /> <br />Ayes: Barnes, Beamer, Gray, Oast, Webb, Whitlow, Johansen <br />Nays: None <br /> <br /> 81-45 On motion of Mr. Beamer and seconded by Mrs. Webb, the following resolution <br />approved on first reading at the Public Hearing of February 9, 1981, was adopted and by the <br />following vote: <br /> <br />(h) <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO THE PORTSMOUTH REDEVELOPMENT AND HOUSING <br />AUTHORITY AND STOP ORGANIZATION TO CONSTRUCT AND OPERATE A CONVALESCENT HOME <br />ON PROPERTY BOUNDED BY LINCOLN STREET ON THE NORTH, SIXTH STREET ON THE WEST, <br />NELSON STREET ON THE SOUTH AND FIFTH STREET ON THE EAST. <br /> <br /> WHEREAS, Portsmouth Redevelopment and Housing Authority by Harvey N. Johnson, Jr., <br />agent for the STOP Organization, has made application pursuant to Section 40-75 (b) of the <br />Code of the City of Portsmouth, Virginia, as amended, for the granting of a use permit as <br />hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be <br />done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working <br />in the neighborhood of the proposed use; and <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; and <br /> <br />(c) Will be in accord with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. Portsmouth Redevelopment And Housing Authority and the STOP Organization are <br />hereby granted a use permit pursuant to Section 40-75(b) of the Code of the City of Portsmouth <br />Virginia, to operate a convalescent home on property described as follows: <br /> <br /> Beginning at the northwest corner of Nelson and Fifth Street; thence <br />north along the west right-of-way of Fifth Street to the south right-of-way <br />of Lincoln Street; thence west along said right-of-way to the east right-of-way <br />of Sixth Street; thence south along said right-of-way to the north right-of-way <br />of Nelson Street; thence east along said right-of-way to Fifth Street, the <br />Point of Beginning. <br /> <br />3. The following conditions are prescribed for this use permit: <br /> <br /> (a) P~ior to approval of any building permits, <br />the appropriate agency of the Commonwealth of Virginia, <br />care and any other permits that may be required for the <br />convalescent or nursing home pursuant to the law of the <br /> <br />the applicant shall obtain from <br />certificates of essential intermediate <br />construction or operation of a <br />Commonwealth of Virginia. <br /> <br /> (b) The facility shall be constructed to accomodate not more than sixty (60) <br />persons. <br /> <br /> (c) Prior to the issuance of any building permit, the applicant shall submit to <br />the City Planning Commission for its approval a site plan, which site plan shall include <br />adequate off-street parking, loading facilities and screening from adjoining residential <br />property. Failure of the Planning Commission to approve or disapprove said site plan at a <br />regular monthly meeting within sixty (60) days of the date the site plan is submitted shall <br />be grounds for appeal to City Council." <br /> <br />Ayes: Barnes, Beamer, Gray, Oast, WKbb, Whitlow, Johansen <br />Nays: None <br /> <br /> <br />
