.326 <br /> <br />July 2&, 1981 <br /> <br /> The Electoral Board of the City of Portsmouth has requested that the Council take action <br />by amending the Code of the City of Portsmouth relative to changes ~n the designation of <br />voting precincts and voting places. The proposed changes would.alter the existing boundaries <br />of Precincts 26 and 27 and create a new precinct to be numbered 28, alter the existing <br />boundaries of Precinct 37 and create a new Precinct to be numbered 38. William E. Waters <br />Junior High School will remain the voting place for Precinct 26, Cavalier Manor Elementary <br />School will remain the voting place for Precinct 27 and Lakeview Elementary School would <br />be designated as the voting place for the new Precinct 28. Churchland Junior High School <br />would be designated as the voting place for Precinct 37 and Grove Baptist Church would serve <br />as the voting place for the new Precinct 38. The proposed changes would also moYe the votin <br />place for Precinct 18 from the Nazerene Church Annex at 4009 Deep Creek Boulevard To the <br />Nazerene Church Fellowship Hall at 2508 Barclay Avenue, and the voting place for Precinct 20 <br />from the Highland Biltmore School on Independence Street near Greenwood Drive to the Asbury <br />Parkside Community Center at ~15 Summers Place. A copy of the correspondence from the <br />Electoral Board of the City of Portsmouth to the City Attorney is attached. The City Manager <br />recommends adoption." <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Beamer, the following ordinance was adopted <br />on first and final reading, and by the following vote: <br /> <br />"kN ©RDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, <br />BY AMENDING SECTIONS 9-42, 9-43, g-44 AND 9-92 THEREOF SO AS TO ALTER THE <br />EXISTING BOUNDARIES OF PRECINCTS NUMBERED 26 AND 27 AND CREATE A NEW PRECINCT <br />TO BE NUMBERED 28 AND DESIGNATE A NEW VOTING PLACE FOR THE NEW PRECINCT 28; <br />BY AMENDING SECTIONS 9-52 AND 9-100 AND BY ADDING TWO NEW SECTIONS NUMBERED <br />9-52.1 and 9-101 SO AS TO ALTER THE EXISTING BOUNDARIES OF PRECINCT 3? AND <br />TO CREATE A NEW PRECINCT TO BE NUMBERED 38 AND TO DESIGNATE VOTING PLACES <br />THEREFOR; BY AMENDING SECTIONS 9-82 AND 9-84 SO AS TO CHANGE THE VOTING <br />PLACES FOR PRECINCTS 18 AND 20." <br /> <br />Ayes: Barnes, Beamer, Gray, Oast, Webb, Whitlow, Johansen <br />Nays: None <br /> <br /> 81-274 - "Consideration of an ordinance <br />Avenue, Spencer Street, Serpell Street, Page <br />Marine Terminal Area. <br /> <br />closing <br />Street, <br /> <br />portiohs of Carolina Avenue, Pinners <br />and Seaboard Avenue in the Portsmouth <br /> <br /> The City of Portsmouth has made application ~o close portions of the above named streets <br />Viewers were appointed pursuant to State law and a copy of their report and a map showing <br />the portions of the streets to be closed is attached for your information. The City Manager <br />recommends adoption." <br /> <br /> John Ridgely Porter, III, 520 Citizens Trust Building, Attorney representing the <br />Virginia Port Authority, spoke in opposition of closing each and everyone of the streets <br />by the proposed ordinance, and requested that the matter be referred back to the Planning <br />Commission. <br /> <br /> B. Vand.eventers, 2050 One Commercial Place, reprsenting Hampton Roads Shipping <br />Association, spoke against the crdinance and requested that the matter be remanded to the <br />P~anning Commission for further consideration. <br /> <br /> Guilford D. Ware, 1640 Virginia National Building, Norfolk, Va., representing Portsmouth <br />Terminals, Inc., spoke in favor of the closing the streets, and suggested if the ordinance to <br />be amended to remove some of the expanding language, particular in the last paragraph, as <br />in his opinion is not needed for anyones protection, but if so, adopt the ordinance as it is. <br /> Attorney, <br /> Joseph L. Kelly,/1700 Virginia National Bank Building,~representing VEPCO, stated that <br />VBPCO maintained numerous underground and overhead lines, and was not opposed ~o closing of <br />the streets. <br /> <br /> Motion_ of.2~r. Barnes .~and. sec on~d ~y ~i ~a~..~h~ a~p~ .t~ .~rRinance: - ' <br /> <br />' Motion of Mr. Whitlow and seconded by Mr. Gray, to suspend the rules for Mr. Kelly to <br />speak, and was adopted by unanimous vote. <br /> <br /> Mr. Kelly stated that VEPCO was not interested in obstructing the closing of these <br />streets if the VPA could tell the company that they are not go~ng to require them to make <br />large expensive move for their utilities. <br /> <br /> Motion of Mr. Whitlow and seconded by Mr. Barnes, to suspend the rules for Mr. Porter <br />to speak, and was adopted by unanimous.vote. <br /> <br /> Mr. Whitlow asked Mr. Porter why he couldn't give VEPCO an easement for their utilities. <br /> <br /> Mr. Porter replied and stated that Mr. Kelly would require something from the VPA at <br />5 o'clock today and that he explained ~o Mr. Kelly that he would have to go back to the Board <br />of Commissioners of VPA and that he would take the matter to themcon October 6, 1981, the <br />next regular meeting. <br /> <br /> Motion of Mr. Barnes and seconded by Mr. Gray, to suspend the rules for Mr. Ware to <br />speak, and was adopted by unanimous vote. <br /> <br /> Mr. Ware stated that VPA called VEPCO only la~e last week to raise the question on the <br />easemen~ now why to delay tke street closing. No one is going to deny the u~ilities there. <br /> <br /> <br />
