352 <br /> <br />September 8, 1981 <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO RELEASE EASEMENTS RESERVED FOR PUBLIC <br /> <br />UTILITIES IN THE MOUNT HERMON AREA. <br /> <br /> WHEREAS, by Ordinance No. 1977-140 adopted by the Council of the City of Portsmouth, <br />Virginia, on October 11, 1977, a portion of Kirn Avenue lying between High Street and <br />County Street was closed; and <br /> <br /> WHEREAS, by Ordinance No. 1978-34 adopted by the Council of the City of Portsmouth, <br />Virginia, on March 14, 1978, portions of Cutheriell, McKinley, Whitson, County and Hickory <br />Streets were closed; and <br /> <br /> WHEREAS, by the terms of said Ordinances the City of Portsmouth retained an easement <br />in said former streets for the purpose of operating and maintaining public utilities; and <br /> <br /> WHEREAS, said public utilities have been relocated in connection with nhe development <br />of the Mount Hermon Redevelopment and Conservation Project; and <br /> <br /> WHEREAS, the City no longer has a requirement for said utility easemenns and the same <br />are hereby declared to be surplus. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that the City Manager be, and he hereby is, authorized ~o release said public utility <br />easements zn that portion of Kirn Avenue closed by Ordinance No. 1977-140 and Cutheret%, <br />McKinley, Whitson, County and Hickory Streets closed by Ordinance No. 1978-34. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he here hereby is, authorized to <br />execute such deed of release as may be necessary to accomplish the purpose of this Resolution. <br /> <br />Ayes: Barnes, Beamer, Gray, Oast, Webb, ~hitlow, Johansen <br />Nays: None <br /> <br /> 81-328 "Consideration of a resolution closing portions of Wythe, Harrzson, and <br />Randolph Streets. <br /> <br /> The City of Portsmouth has made application to vacate and close portions of Wyth~q~ <br />Harrison, and Randolph Streets. This resolution appoints viewers pursuant to Stane law <br />for a report back to City Council. The City Manager recommends adoption." <br /> <br /> On motion of Mr. Whitlow and seconded by Mr. Gray, the following resolution was <br />adopted, and by the following vote: <br /> <br /> "A RESOLUTION APPOINTING VIEWERS FOR THE CLOSING OF A PORTION OF WYTHE STREET, <br /> HARRISON STREET AND RANDOLPH STREET. <br /> <br /> WHEREAS, the City of Portsmouth has made application to vacate, close and discontinue <br />the hereinafter-described portions of certain streets, and it appearing that Notice o£ appli- <br />cation and request for the appointment of viewers was duly posted on August 25, 1981, on <br />the bulletin board of the City Hall Building of the City of Portsmouth, the General District <br />Court, Civil Division, and the Circuit Court of the City of Portsmouth. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />A. N. Kendrick, Linon Vann, C. H. Hairston, James H. Griffin and James L. Linehan be appointee <br />viewers and that J. R. Wilkerson and Howard L.
