35D <br /> <br />Ne~tem~ ~ lq~l <br /> <br /> 81-307 On motion of Mr. Gray and seconded by Mrs. Webb, the following resolution ap- <br />proved on first reading the regular meeting August 25, 1981, was adopted and by the following <br />vote: <br /> <br /> "A RESOLUTION GRANTING APPROVAL POR A GROUP HOUSING PROJECT PURSUANT TO SECTION <br /> 40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, AS AMENDED, SAID <br /> PROJECT BEING KNOWN AS "CYPRESS COVE VILLAS, PHASE IV" AND DE.SIGNATED AS GHP-81-3. <br /> WHEREAS, Portsmouth Enterprises, Inc. has made application pursuant to Section 40-55 <br />of the Code~ of the City of Portsmouth, Virginia, 1973, as amended, for the granting and <br />approval of a group housing project kncwn as "Cypress Cove Villas, Phase IV". <br /> WHEREAS, the application has been determined by the Planning Commission to have met <br /> requirements of Section 40-55, Code of the City of Portsmouth, Virginia, 1973, as amended; <br /> and <br /> <br /> WHEREAS, the Planning Commission has reviewed such application and site plans submitted <br /> therewith and has recommended approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of the group housing project <br /> pursuant to said Section 40-55 grants only an exemption from certain requirements for <br /> residences as stated in said Section and does not constitute a waiver of any ether requirement <br /> emb_odied in the Subdivision Ordinance, Zoning Ordinance, the ~ode of the City of Portsmouth <br /> or any other applicable State or Federal iaws or regulations; and <br /> <br /> WHEREAS, the developer is aware that building permits and or any other required <br /> permit will be issued only upon compliance with the ordinances, laws, or regulations applicable <br /> thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that the certain group housing project known as "Cypress Cove Villas, Phase IV" and des2gnated <br />as GHP-81-3, and more specifically shown on plans prepared by Dan E. Griffin, A.I.A., <br />filed with the appropriate officials of the City of Portsmouth and made a part hereof, is <br />hereby grante& approval." <br /> <br />Ayes: Beamer, Gray, Q~B~, Webb, Whitlow, Johansen <br />Nays: None <br />Abstaining: Barnes <br /> <br /> 81-310 - The following ordinance approved <br />August 2£, 1981, was taken up and read: <br /> <br /> "AN ORDINANCE TO APPROPRIATE 160,00E FROM THE PUBLIC UTILITIES CAPITAL IMPROVEMEN~ <br /> FUND FOR THE COMPLETION OF DESIGN IMPROVEMENTS AT THE LAKE KILBY WATER TREATMENT <br /> PLANT." <br /> <br />on first reading at the regular meeting of <br /> <br /> On <br />following <br /> <br />motion of Mrs. Webb and seconded by Mr. Gray, the ordinance was adopted, and by the <br /> <br />Beamer, Gray, <br /> <br />Oast, Webb, Whitlow, <br /> <br />vote: <br /> <br /> Ayes: Barnes, <br /> Nays: None <br /> <br /> 81-311 The following ordinance approved on first reading <br />August 25, 1981, was taken up and read: <br /> <br /> Johansen <br /> <br />at the regular meeting <br /> <br />FOR <br /> <br />"AN ORDINANCE TO APPROPRIATE $35,000 FROM THE CAPITAL IMPROVEMENT FUND <br />MATERIAL AND EQUIPMENT FOR REPAIR AND REPLACEMENT OF SIDEWALKS." <br /> <br /> On motion of Mr. Gray and seconded by Mr. Beamer, <br />foilowing vote: <br /> <br /> Ayes: Barnes, Beamer, Gray, Oast, Webb, <br /> Nays: None <br /> <br />of <br /> <br />the ordinance was adopted,and by the <br /> <br /> Whitlow, Johansen <br /> <br /> 81-312 The following ordinance approved on first reading at the regular meeting of <br />August 25, 1981, was taken up and read: <br /> <br />"AN ORDINANCE TO APPROPRIATE $6,100 FROM THE CAPITAL IMPROVEMENT FUND FOR <br />ENGINEERING sTuDIES ON THE CRAWFORD HARBOR AND THE FLOOD PROTECTION FACILITIES <br />IN THE DOWNTOWN WATERFRONT SEAWALL AREA." <br /> <br /> On motion of Mr. Gray and seconded by Mrs. Webb, the ordinance was adopted, and by the <br />following Vote: <br /> <br /> Ayes: Barnes, Beamer, Gray, Oast, Webb, Whitlow, Johansen <br /> Nays: None <br /> <br /> The following reports from the City Manager were presented: <br /> <br /> 81-323 "Consideration of an ordinance on first reading to appropriate $2D,874 <br />from the Capital Improvements Fund for interior furnishings and equipment for the new <br />Winchester Drive Fire Station. <br /> <br /> This appropriation provides the necessary funds for the purchase of interior furnishings <br />and equipment for the new Winchester Drive Fire Station.
