360 <br /> <br />September 29. 1981 <br /> <br /> On motion of Mr. Gray and seconded by Mr. Whitlow, the following resolution was <br />and by the following vote: <br /> <br /> "A RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY A RIGHT-OF-WAY EASEMENT <br /> TO VIRGINIA ELECTRIC AND POWER COMPANY ON PROPERTY LOCATED ON THE SOUTH SIDE OF <br /> CHURCHLAND BOULEVARD (CHURCHLAND ACADEMY). <br /> <br />adopted, <br /> <br /> WHEREAS, the Virginia~Department of Highways and Transportation is widening Churchland <br />Boulevard in the vicinity of Churchland Academy Elementary School; and <br /> <br /> WHEREAS, said project will facilitate vehicular traffic near the intersection of <br />Churchland Boulevard and West Norfolk Road; and <br /> <br />the purpose of relocating electric power <br />street improvement project; and <br /> <br />WHEREAS, Virginia Electric & Power Company has requested a right-of-way easement for <br /> transmission lines in order to facilitate said <br /> <br /> WHEREAS, the City of Portsmouth owns property along the <br />Boulevard, known as the Churchland Academy Elementary School, <br />power transmission lines will be relocated. <br /> <br />south side of Churchland <br />over which said electric <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that the City Manager be, and he hereby is, authorized to convey to Virginia Electric and <br />Power Company a right-of-way easement on Froperty located on The south side of Churchland <br />Boulevard (Churchland Academy Elementary School); said right-of-way easement being more <br />particularly described on the attached plat entitled "Virginia Electric ~ Power Company Plat <br />To Accompany Right-Of-Way Agreement, R/W 35830." <br /> <br /> BE IT FURTHER resolved that the City Manager be, and he hereby is, authorized to execute <br />such documents as may be necessary to complete this transaction." <br /> <br />Ayes: Barnes, Beamer, Gray, Webb, Whitlow, Johansen <br />Nays: None <br /> <br /> 81-355 - <br />CommissioNs: <br /> <br /> NEW BUSINESS <br /> <br />Mr. Whitlow offered the following nominations <br /> <br />for appointments to Boards/ <br /> <br /> Patrick Henry Hospital Board <br /> <br /> V. Brown, to be reappointed for a term of four years, effective <br />of October 1, 1981. <br /> <br /> Motion of Mrs. Webb and seconded by ~{~. <br />further nominations, the above members to be <br />was adopted by unanimous vote. <br /> <br />Gray, to close nominations, and there being no <br />elected to the designated BoardICommission, and <br /> <br /> 81-356 - Motion of Mr. Barnes and seconded by Mr. Gray, to go into an executive session <br />to discuss a legal matter, and was adopted by unanimous vote. <br /> <br />ThefCouncil reconvened at 9:3[ p.m. <br /> <br /> 81-357 - Motion of Mr. Barnes and seconded by Mrs. Webb, to amend Ordinance No. 8]-64 <br />regarding garage s&les and to include the following: exempt sales held at churches, other <br />places of worship, public or private schools or other similar places of public assembly. <br /> <br /> Substitute Amendment of Mr. Whitlow and seconded by Mr. Beamer, that licenses are not <br />required for the sales of public places such as churches, schools, etc. if the sales are under <br />the auspices of charitable, civic, or ati~er non-profit ~rganizations, and was adopted by 5-1 <br />[Nay=Barnes) vote. <br /> <br /> Motion of Mr. Barnes and seconded by Mr. Beamer, to suspend the rules for Mrs. Shirley <br />Frenia to speak, was adopted by unanimous vote. <br /> <br /> Mrs. Shirley~Frenia, a016 Windymille Dr., representing Merrifields Garden Club, spoke <br />concerning obtaining a permit beside paying for space rental. <br /> <br /> ~Motion of Mr. Beamer and seconRed by Mr. Gray, to suspend the rules for Warren Harris ~o <br />sFeak~ was a~opted by unanimous route. ~ ~, <br /> Mr.~Warren Harris, 1406 Ga%son Crescent,' member 0{ CAC, stated.it was the intent of the <br />C~C that the-oTdinance would exempt the commercial areas and non-profit organizations, but <br />primarily nrying to ccntrol the residential sales. <br /> On motion, tbe~oI~o~ng ordingI~c.~ as amen~, ~o.be~ ef.fective as of .Octobe~ 1, 1981, was <br />adopted on first and final rea~ing-~ and By 'the following ~ote: <br /> <br /> <br />
