36.7 <br /> <br />October 13, 1981 <br /> <br />At a regular meeting of ~he City Council held on October 13, 1981, there were present: <br /> <br />J. E. Johansen, Ben A. Beamer, Sr., J. Robert Gray, Edward L. Oast, Jr., <br />Gloria O. Webb, Morton V. Whitlow, G. Robert House, Jr., City Manager, <br />Steven Lieberman, City Attorney. <br /> <br />Absent: Jack P. Barnes. <br /> <br /> Rev. T. M. Frye, Pastor, Biltmore Baptist Church, opened the meeting with prayer, <br />followed by the Pledge of Allegiance to the Flag. <br /> <br />Mayor Johansen welcomed all visitors in attendance. <br /> <br /> Motion of Mr. Gray and seconded~by Mr. Beamer, minutes of the called meeting of <br />September 29, 1981; minutes of the regular meeting of September 29, 1981, so be approved <br />as received, and was adopted by unanimous vote. <br /> <br /> 81-369 Mr. E. Wallace Timmons, Director of Public Affairs, Tidewater Automobile <br />Association of Virginia, introduced Mr. Judson H. Ro~man, First Viee President of Tidewater <br />Automobile Association, who presentet the 1981 AAA National Award of Excellence for Pe~ <br />Safety to Mayor Johansen, honoring the City of PortsmoUth £or an outstanding success in <br />pedestrian accident r~dord and safety implementation. Also, in attendance for the presenta- <br />tion was Messrs. S. F. Duncan, Manager of Portsmouth Division of TAA and Paul Stokley of the <br />TAA Board. <br /> <br />UNFINISHED BUSINESS <br /> <br /> 81-338 - On motion of Mr. B~eamer and $~cOnd'ed b~ Hrs. Webb, ~he following resolution <br /> ~pp~ved~o~~ first reading at the regular meeting of September 29, 1981 ~as adopted and by <br /> the following vote: ' <br /> <br /> "A RESOLUTIO~ AMENDING A USE PERMIT GRANTED TO TIDEWATE~ BI.BLEWAY TEMPLE <br /> TO OPE~R~TE A CHURCH;OR HOUSE ~OF WORSHIP AT 504-510 HIGH STREET. <br /> <br /> WHEREAS, the Council of the City of Portsmouth, Virginia, by Resolution adopted August 2~ <br />1980, granted a use~perm&t pursuant to ~Section 4~-120(ai and Se~.ion 40-~2(b) of the Code of <br />the City of Portsmouth, V~rginia, to operate a church or house of worship on the property <br />as 50~-510 High Street; and <br /> <br /> WHEREAS, the terms and conditions of said use permit instructed the City Manager to <br />advise the City Council on the status of the permit and ~o recommend such modification or <br />termination of the conditional use permmt as may be deemed appropriate in the event that <br />Tidewater Bibleway Temple fail to obtain permits for construction, alteration or renovation <br />of the property not later than December 31, 1980; and <br /> <br /> WHEREAS, due to circumstances beyond the control of Tidewater Bibleway Temple, permits fo <br />exterior construction were not obtained within the time required by the use permit; and <br /> <br /> WHEREAS, Tidewater Bibleway Temple have petitioned for the granting of an amendment to <br />the use permit; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be don~ <br />in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended that the use permit be amended. <br /> <br /> NQW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the permit is sought and the amendment requested: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or .working <br />in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to property or improve- <br />ments in the neighborhood; and <br /> <br />a church <br />shall be <br /> <br />granted <br /> <br /> (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. <br /> <br /> That the use permit granted Tidewater Bibleway Temple on August 26, 1980 to operate <br /> or house of worship on the property described therein and known as 504-510 High Stree <br /> amended as provided in Paragraph 3 hereof. <br /> <br /> The following conditions are prescribed for the use permit as amended: <br /> <br /> (a) The conditions contained in Paragraph 3(a) (c) (d) and (e) of ~he use permit <br />on August 26, 1980. ~ ' ' <br /> <br /> (b) All permits for construction, alteration or renovation of said property must <br />be secured not later than February 1, 1982. <br /> <br /> (c) That the certificate of occupancy will not be issued until all permits for <br />construction, alteration or renovation, including exterior permits be obtained along with <br />submission of drawings and contractual agreements. <br /> <br /> <br />
