That the use for which the use permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing <br />in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; and <br /> <br /> (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. <br /> <br />P. COOK, SR. TO OPERATE A JUNKYARD <br /> AT ?00 YORKTOWN AVENUE. <br /> <br /> WHEREAS, Earl J. Cook, Sr., made an application pursuant to S40-69(b) of the Code of th~ <br />City of Portsmouth, 1973, for the granting of a use permit as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be <br />done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br />1. Earl J. Cook, Sr. is hereby granted a use permit pursuant to §~0z69(b) of the City <br />Code to operate a junkyard on the property described as follows: <br /> <br />UP-81-17 <br /> <br /> Beginning on the east side of Yorktown Avenue 121', more or less, south from <br />its intersection with County Street; thence south 151.88' to a point; thence north- <br />west 283.24'; thence southwest 29.72'; thence north 89.60'; thence east 300' to <br />the east right-of-way line of Yorktown ~venue, the Point of Origin. <br /> <br />3. The following conditions are prescribed for this use permit: <br /> <br /> (a) The applicant shall operat~ a service <br />dismantling of used automobiles and the storage of <br />posing of the remains of automobiles. <br /> <br />garage or wrecker service for the <br />salvaged parts in a garage and the dis- <br /> <br /> (b) He is not to shear automobiles. He is not to store aunomobile skeletons <br />permanently on the property. <br /> <br /> (c) Off street parking spaces will be provided sufficient for all <br />operated by the enterprise, plus one (1) space for each five (5) employees <br />greatest number of persons to be emoloyed at any one period during the day <br />required by City ordinances. <br /> <br />vehicles <br />computed on the <br />and night as <br /> <br /> (d) All junk automobiles awaiting disassembly and auto skeletons awaiting removal <br />must be stored within the fence compound. No temporary parking, stopping or storage of <br />junk or skeleton automobiles outside the fenced compound will be permitted. <br /> <br /> <br />
