October 27, 1981 BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: NOW, T~EREFORE, 1. That the use for which the use permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; and (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. Ayes: Barnes, Beamer, Gray, Oast, Webb, Whitlow, Johansen Nays: None 81-367 On motion of Mr. Beamer and seconded by Mrs. approved on first reading at the Public Hearing of October following vote: Webb, the following resolutia.n 12, 1981, was adopted and by the (g) UA RESOLUTION GRANTING A USE PERMIT TO EARL J. COOK, SR. TO OPERATE A JUNKYARD AT ?00 YORKTOWN AVENUE. WHEREAS, Earl J. Cook, Sr., made an application pursuant to S40-69(b) of the Code of th~ City of Portsmouth, 1973, for the granting of a use permit as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. Earl J. Cook, Sr. is hereby granted a use permit pursuant to §~0z69(b) of the City Code to operate a junkyard on the property described as follows: UP-81-17 Beginning on the east side of Yorktown Avenue 121', more or less, south from its intersection with County Street; thence south 151.88' to a point; thence north- west 283.24'; thence southwest 29.72'; thence north 89.60'; thence east 300' to the east right-of-way line of Yorktown ~venue, the Point of Origin. 3. The following conditions are prescribed for this use permit: (a) The applicant shall operat~ a service dismantling of used automobiles and the storage of posing of the remains of automobiles. garage or wrecker service for the salvaged parts in a garage and the dis- (b) He is not to shear automobiles.
