July 10, 2001 <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A PIPELINE <br />LONGITUDINAL OCCUPANCY AGREEMENT WITH CSX TRANSPORTATION, INC., <br />FOR THE CONSTRUCTION OF PIPING IN THE CSX RAILROAD RIGHT-OF-WAY <br />CONNECTION. <br /> <br /> WHEREAS, the City of Portsmouth, as part of the Frederick Boulevard Booster <br />Pump Station and Water Storage Facility Project, will be making piping connections to <br />the water main transmission mains; and <br /> <br /> WHEREAS, a portion of the piping connections construction will be performed in <br />the railroad right-of-way belonging to CSX Transportation, Inc.; and <br /> <br /> WHEREAS, the CSX Transportation, Inc., is agreeable to the proposed piping <br />connections with the execution of its standard Pipeline Longitudinal Occupancy <br />Agreement. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia, that the City Manager is hereby directed and authorized to <br />execute a Pipeline Longitudinal Occupancy Agreement with CSX Transportation, Inc., <br />for the construction of piping connections with the CSX railroad right-of-way; and that <br />the City Clerk is directed to affix the Corporate Seal of the City thereto and attest the <br />same." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />01 - 209 - Adoption of a resolution to participate in the Statewide Mutual Aid program in <br />order to render and receive assistance during times of emergencies. <br /> <br />Recommendation: <br /> <br />· Adoption of a resolution to participate in the Statewide Mutual Aid program in order <br />to render and receive assistance during times of emergencies. <br />· <br />Purpose and Need: <br /> <br />· Last year, the Virginia General Assembly approved the establishment of a Statewide <br />Mutual Aid (SMA) Program. The SMA Program was developed to assist cities and <br />counties to more effectively and efficiently exchange services and resources, especially <br />in response to a major disaster wherein assistance needs to be provided from one area <br />or region of the State to another. <br /> <br />· The development of the SMA Program was the result of several years of work by a <br />committee consisting of most of the organizations aligned with emergency response in <br />the Commonwealth including a number of State agencies, the Virginia Municipal <br />League, the Virginia Association of Counties, as well as the Local Government <br />Attorneys Organization. <br /> <br />· The SMA Program resolves inconsistencies and uncertainties concerning the <br />insurance and liability coverage of emergency workers when deployed from one locality <br />to another and takes full advantage of opportunities for federal/state reimbursement of <br />deployment-related costs. <br /> <br />· This program is supplemental to, and does not affect, existing day-to-day mutual aid <br />agreements that typically exist between or among adjacent or nearby localities. <br /> <br />Financial Impact: <br /> <br />· The SMA Program provides a mechanism (if needed) for the reimbursement of <br />deployment-related costs from the "Requesting Party" to the "Assisting Party" and, in <br />turn, potentially for the subsequent reimbursement of some or all of these costs from the <br />federal government and/or the State government to the Requesting Party, especially in <br />the event of a federal disaster declaration. <br /> <br />· A political subdivision's responsibility to respond is based on the availability of their <br />resources. <br /> <br /> <br />
