January 12, 1982 <br /> <br /> (c) The play area will be not less than 80' x 40' and will be surrounded by masonary <br />walI or solid wood fence az least five (5') in height. <br /> <br /> (d) The petitioner shall ,comply with all codes, ordinances, policies and regulations <br />of federal, sta~e and local governments that may be applicable and shall have obtained all <br />necessary licenses and permits required for this use. <br /> <br /> (e) This use permit is issued to the Central Baptist Church and is not transferable <br />to any other person or entity.- <br /> <br />(e) "A RESOLUTION GRANTING A USE PERMIT TO THE PORTSMOUTH COMMUNITY SERVICES BOARD <br /> TO OPERATE AN ADULT DAYCARE ~CENTER AT 3705 ARLINGTON PLACE. <br /> <br /> WHEREAS, Bishop Walter F. Sullivan, by David M. Norman, Director of the Portsmouth <br />Community Services Board, made an application pursuan~ to §40-75(b) of the Code of the <br />City of Portsmouth, 1973~ for the granting of a use permit as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be <br />done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permxt hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working <br />in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or improve- <br />ments in the neighborhood; and <br /> <br />(c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. The Portsmouth Community Services Board is hereby granted a use permit pursuant to <br />§40-75(b) of the Code of the City of Portsmouth, Virginia, to operate an adult daycare center <br />as defined by §40-75(b) of the C~de of the City of Portsmouth, 1973, on the property describe~ <br />as follows: <br /> <br />UP-81-25 <br /> <br /> Beginning on the north side of Winchester Drive 240 feet, more or less, <br />east from its intersection with Airline Boulevard; thence east along Winchester <br />Drive 65 feet, more or less; thence southeast 85 feet, more or less; thence <br />north 150 feet, more or less to the south right-of-way of Arlington Place; <br />thence west along said right-of-way 135 feet, more or less; thence south to <br />Winchester Drive, the point of origin. <br /> <br />3. The following conditions are prescribed for this use permiz: <br /> <br /> (a) That a minimum of six [6) parking spaces will be provided in the existing lot <br />to the west of the building, and such parking facilities will be built in accordance with <br />the requirements for parking lots promulgated by the City Engineer for the City of Portsmouth <br />Virginia. <br /> <br /> (b) That any exterior sign must be reviewed and approved by <br />Office before being installed and any such sign must comply with all <br />and regulations of the City of Portsmouth applicable to signs. <br /> <br />the City Planning <br />ordinances, policies <br /> <br /> (c) The use permit is issued ~o the Portsmouth Community Services Board and is not <br />transferable to any other person or entity. <br /> <br /> (d) The applicant shall comply with all statutes, ordinances, policies and regulation <br />of federal, state and local governments that may be applicable and shall have obtained all <br />necessary licenses and permits required for this use." <br /> <br />"AN ORDINANCE AMENDING SECTION 40-68.L(e) OF THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, PERTAINING TO USES PERMITTED THROUGH THE ISSOANCE OF A USE PERMIT <br />WITHIN THE M-1-R ZONING DISTRICT." <br /> <br />The following reports from the City Manager were presented: <br /> <br /> 82-5 "Consideration <br />Capital Improvements Fund <br />facilities. <br /> <br />of an ordinance on first reading to appropriate $20,000 from the <br />to complete construction of the police evidence storage and office <br /> <br /> This appropriation will provide funds ~o complete construction of police evidence <br />storage and office facilities in the undsrground parking area of the Police Department. <br />Physical evidence is currently stored in 13 jail cells adjacent to the prisoner intake <br />area of the Civic Center. This projec~ is included in the 1981-86 Capital Improvemen~ <br />Program and will ~ncrease the incarceration capacity of the City Jail. The City Manager <br />recommends adoption on first reading. <br /> <br /> <br />
