January 12, 1982 <br /> <br />At a regular meeting of the City Council held on January 12, 1982, there wera present: <br /> <br />J. E. Johansen, Jack P. Barnes, Ben A. Beamer, Sr., J. Robert Gray, Edward L. <br />Oast, Jr., Gloria O. Webb, Morton, v. Whitlow, G. Robert House, Jr., City Manager, <br />Steven Lieberman, City Attorney. <br /> <br /> Rev. James D. Smith, Pastor, St. Chirstopher's Episcopal Church, opened the meeting with <br />prayer, followed by the Pledge of Allegiance to the Flag. <br /> <br />Mayor Johansen welcomed all vzs~tors in attendance. <br /> <br /> Motion of Mr. Gray and seconded by Mrs. Webb, minutes of the called meeting of December <br />7, 1981; minutes of the Public Hearing of December 7, 1981; minutes of the reconvened meeting <br />of December 8, 1981; minutes of the regular meeting of December 8, 1981, to be a~proved as <br />received, and was adopted by unanimous vote. · <br /> <br /> 82-2 Mayor Johansen presented Certificates of Appreciation John M. Hallahan, former <br />member of the Library Board; Adm. Ross P. R. Bullard and Irving Johnson, Jr., former members <br />of the Museum and Fine Arts Commission; J. Hunter Brantley, Jr. and Moses F. Gibson, Jr., <br />former members of the Southeastern Tidewater Opportunity Project (STOP); and Joseph T. Barnes and~secmnded by ~rs,. }~ebb, ~Agenda I'tems <br />(g) ~a~proved-on fi~st'reAd~ng'~at.'the .Pub!'ic'~He~ng of'De~ember..7,'"~98t;~and <br />following vote:. - ' ~ ' ~ ..... - ' - ~ - <br /> <br /> Ayes: Barnes, Beamer, Gray, Oast, Webb, Whitlow, Johansen <br /> <br /> 8~-435 · <br /> <br />(b) "ZONING AMENDMEN7 ORDINANCE Z 81-13" <br /> <br />were adopted by <br /> <br />(d) "A RESOLUTION GRANTING A USE PERMIT TO CENTRAL BAPTIST CHURCH TO OPERATE A <br /> CHILD DAYCARE CENTER AT 1200 HODGES FERRY ROAD. <br /> <br /> WHEREAS, Central Baptist Church, by Terri Laman, Pre-School Supervisor, made an appli- <br />cation pursuant to ¢40-77(b) of the Code of the City of Portsmouth, Virginia, 1973, for-the <br />granting of a use permit as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be <br />done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit hereinafter xs sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working <br />in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurmous to the property or improve- <br />ments in the neighborhood; and <br /> <br />(c) Will be in accordance with ~he purposes of the Zoning Chapter of the City <br /> <br />Code. <br /> <br /> 2. Central Baptist Church is hereby granted a use permit pursuant to ~40-77[b) of the <br />City Code to operate a child daycare center at the property described as follows: <br /> <br />UP-81-23 <br /> <br /> Beginning at the southwest corner of Hodges Ferry Road and Logan Drive; <br />thence southerly along the west right-of-way of Logan Drive 401.20'; thence <br />westerly 876.02'; thence northerly 188.56'; thence easterly 319.81'; thence <br />northerly to the south right-of-wa~ of Hodges Ferry Road; thence east along <br />said right-of-way to Logan Drive, the point of ormg~n. <br /> <br />3. This use permit is approved subject to the following conditions: <br /> <br /> (a) The child care center may be operated for enrollment of not more than thirty- <br />seven (37) children, and will be limited to children between the ages of two and one-half <br />(2-1/2) to six (6) years. <br /> <br /> (b) The interior operation of the facility will be conducted only between the hours <br />of 6:00 A. M. ~o 6:00 P. M.. The exterior playyard facilities will only be used between the <br />hours of 8:00 A.'M. to 6:00 P. M.. <br /> <br /> <br />
