<br /> WHEREAS, the STOP Organization filed its application with the State Commissmoner of Healt
<br />~or a Certificate of Need in February 1981 and received all subsequent procedural approvals
<br />including the issuance of a use permit by this Council and the approval of the Eastern Virgini
<br />Health Systems Agency; and
<br />
<br /> WHEREAS, the Certificate of Need was denied by the Commissicner of Health despite the
<br />recommendation of his staff that it be approved; and
<br />
<br /> WHEREAS, the Council of the City of Portsmouth recognizes the need for the proposed
<br />facility and the benefits that can result for the citizens of the City of Portsmouth from its
<br />approval.
<br />
<br /> NOW, THEREFORE, BE IT R~SOLVED that the Council of the City of Portsmouth expresses its
<br />support for the construction of the proposed facility in the Southside Redevelopment Area
<br />and requests that the Commissioner o£ Health reconsider his denial of STOP's application for
<br />a Certificate of Need.

<br /> BE IT FURTHER RESOLVED by the Council of the City of Portsmouth that the City Clerk be,
<br />and she hereby is, directed to forward copies of this Resolution to the State Ccmmissioner
<br />of Health and to the members of the Portsmouth Delegation to the General Assembly of Virginia

<br /> Frank Harte, 3403 Dogwood Drive, representing Siesta Civic League, spoke in support
<br />of a written procedure for Council proceedings, and the League's comments and views on the
<br />document. (See Exhibit~8~46~)

<br /> Councilman Barnes responded to Mr. Lewis and Mr. Harte~ and informed them as Chairman
<br />of the Rules and Procedure Committee, that their recommendations would be reviewed and dis-
<br />cussed.

<br /> 82-47 The following communication was received from Winship C. Denton, Counsel of
<br />Kaufman & Canoles, A Professional Corporation, Norfolk, VA:
<br />
<br />"Re: Industrial Revenue Bond Financing of B~uipment for Commercial Insurance A~ency
<br />
<br /> We are ~ctiBg as~.~-~n~ cnnnsel to PH Associates, a Virginia general partnership, which
<br />proposes to acquire certain computer, zerox and office machinery and equipment. PH Associate~
<br />proposes to finance the acquisition of such equipment with an indust?ial development revenue
<br />bond. On October 29, 1981, the Industrial Development Authority of the City of Norfolk
<br />adopted an Inducement Resolution whereby it agreed to use its bes efforts to issue its bond
<br />in the pricipal amount of $200,000 to finance the equipment for PH Associates. United Virgini
<br />
<br />Bank has agreed to purchase the bond.
<br />
<br /> PH Associates plans to use approximately $100,000 of the bond proceeds to purchase equip-
<br />ment for lease to Commercial Insurance Agency for use in its offices at 801 Loudoun Avenue
<br />in Portsmouth. Section 15.1-1378 of the Code of Virginia of 1950, as amended, requires the
<br />governing body of the city in which equipment is located that is being financed by an industri
<br />development authority of another city to concur in such financing.

<br /> We, therefore, hereby request the City Council of Portsmouth to adopt a resolution con-
<br />curring with an~ consenting to the issuance by the Industrial Development Authority of the
<br />City of Norfolk of its 1981 Industrial Development Revenue Bond (PH Associates Bquipment) in
<br />the principal amount of $200,000, the proceeds of which will be used to finance equipmenz for
<br />PH Associates to be located in both the Cities of Norfolk and Portsmouth.
