February 23~ 1982 <br /> <br /> 82-74 - On motion of Mr. Barnes and seconded by ~rs; Webb, the following resolution was <br />adopted~ and by the following vote: <br /> <br /> "A RESOLUTION OPPOSING THE ADOPTION O~ LEGISLATION WHICH WOULD PROHIBIT <br /> LOCAL GOVERNMENTS FROM UTILIZING VALID ZONING ORDINANCES TO REGULATE THE <br /> LOCATION OF AN ESTABLISHMENT SELLING ALCOHOLIC BEVERAGES., <br /> <br /> WHEREAS, there is currently pending in the General Assembly of Virginia proposed legis- <br />lation which would prohibit counties, cities or towns from adopting any zoning ordinance or <br />other land use ordinance to regulate the location of an establishment selling alcoholic bev- <br />erages; and <br /> <br /> WHEREAS, the Supreme Court of Virginia has recently ruled that a municipality may utiliz <br />valid zoning ordinances to regulate the location of an establishment selling alcoholic bever- <br />ages as a means to prevent the use of land in a manner the City deems detrimental to the <br />general welfare of its inhabitants and as having a deleterious effect on the community; and <br /> <br /> WHEREAS, the Council of the City of Portsmouth is of the opinion that the local governin <br />body is the best level of government to determine the means and methods by which the public <br />health, safety, convenience and welfare of its citizens can be protected and to facilitate th <br />creation of a convenient, attractive and harmonious community. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth that it opposes <br />the adoption of any legislation which would restrict the right of the local governing body to <br />determine land use issues and, in particular, any legislation which would prohibit local gov~ <br />ernments from utilizing valid zoning ordinances to regulate the location of an establishment <br />selling alcoholic beverages. <br /> <br /> BE ~T FURTHER RESOLVED that the City Clerk be, and she hereby is, directed to forward <br />copies of this resolution to the Portsmouth delegation ~o the General Assembly of Virginia." <br /> <br />Ayes: Barnes, Beamer, Gray, Oast, Webb, Whitlow, Johansen <br />Nays: None <br /> <br />On motion meeting adjourned. <br />APPROVED ~.. <br /> <br />City Clerk <br /> <br />* Councilman Barnes thanked Mr. Clemons for his presentation regarding the Council <br />Procadures and stated that the reccmmendations, along with any others, would be considered. <br />Incaddition, any other recommendations should be submitted to the Committee by the end of <br />March, in order for the Committee to review the prgpos~d changes and make their recommendation <br />to Council. <br /> <br /> <br />
