<br /> 82-103 '~Consideration of an ordinance to'amend the City Code pertaining To Commercial
<br />Recreation Centers.
<br />
<br /> The proposed amendments would provide further clarification for the administrative pro~
<br />cessing of applications for Commercial Recreation Centers.
<br />
<br /> On motion of Mr. Barnes and seconded by Mrs. Webb, the following ordinance was adopted
<br />one, first and final reading, and by the following vote:
<br />
<br />"AN ORDINANCE TO AMEND SECTION 3-33 AND 3-34 OF THE CODE OF THE CITY OF
<br />PORTSMOUTH, VIRGINIA, 1973, PERTAINING TO COmmERCIAL RECREATION CENTERS."
<br />

<br />
<br /> 82-104 "Consideration of an ordinance to amend the City Code by amending Sectisn 6-9
<br />thereof, pertaining to fire limits in the City of Portsmouth pursuant to Section 301.2 of the
<br />Basic Building Code.
<br />
<br /> The Portsmouth Redevelopment and Housing Authority and Other developers have periodically
<br />inquired with regards to the boundary of the City's Fire District. Said district establishes
<br />significantly more stringent building code requirements. The staff has recently concluded a
<br />review of the fire district and has recommended that the district be reduced in size since the
<br />affected area is not considered to warrant such additional and expensive requirements. The
<br />City Manager recommends adoption."

<br /> Motion of Mr. Whitlow and seconded by Mr. Beamer, to adopt the ordinance.

<br /> Substitute of Mr. Whitlow and seconded by Mr. Gray, that the matter be deferred
<br />meeting of April 13, 1982, and was adppted by unanimous vote.

<br /> 82-105 "Consideration of an ordinance to amend the City Code by adding to Chapter 12
<br />thereof, Article III, pertaining to smoke detectors.
<br />
<br /> Since 1975, the Statewide Uniform Building Code has required the installation of smoke
<br />detectors in certain new residential and rental structures. Section 14.1-29.9 of the Code of
<br />Virginia authorizes localities to require smoke detector installation in such structures that
<br />pre-existed the 1975 requirements. The Tidewater Builders Association has urged the adoption
<br />of such an ordinance. The proposed ordinance contains provi§ions for the charging of permit
<br />fees as prescribed by the City Code. The City Manager recommends adoption."

<br /> On motion of Mr. Beamer and seconded by Mr. Barnes, the fol~lowing ordinance was adopted

<br />AS AMENDED, BY AMENDING SECTION 6-9 THEREOF, PERTAINING TO FIRE LIMITS IN
<br />THE CITY OF PORTSMOUTH PURSUANT TO SECTION 501.2 OF BASIC BUILDING CODE."

<br /> 82-106 "Consideration of an ordinan:e to close a 20 foot alley on the east side of
<br />Mariner Avenue.
<br />
<br /> Mr. John A. Bender has petitioned to have a portion of an alleM on the east side of
<br />Mariner Avenue closed. The alley is contiguous to Mr. Bender's property. City Council ap-
<br />pointed viewers on January 26, 1982. A copy of their report and a plat showing the portion
<br />to be closed is attached for your information. The City Manager recommends adoption."
<br />
<br /> On motion of Mr. Beamer and seconded by Mr. Whitlow, the following ordinance was adopted
<br />on first and final reading, and by the folIowing ~ote:

<br />'AN ORDINANCE CLOSING A 20 FOOT ALLEY ON THE EASTERN SIDE OF MARINER AVENUE."

<br /> 82-107 "Consideration of an ordinance to amend the City Code pertaining to offenses
<br />against the peace.
<br />
<br /> This ordinance rectifies certain enforcement problems relative to indecent exposure.
