178 October 26, 1982 82-361 October 11, (d) "ZONING AMENDMENT ORDINANCE Z On motion following vote: concerns) of Mrs. Webb and seconded (Coun:il asked that the 82-361 Rpproved on The following ordinance approved on first reading at the Public Hearing of 1982, was taken up and read: 82-23" by Mr. Whitlow the crdinance was adopted, and by Industrial Development Authority be informed of Ayes: Barnes, Beamer, Gray, Holley, Webb, Whitlow, Johansen Nays: None - On motlon, o~Mr. Beame and seconded by Mr. Barnes thekfd~tewing resolution firs~ reading at'th~ 'Pubti~ Hearing of October 11, 1982, was adopted and by the following vote: (e) "A RESOLUTION GRANTING A USE PERMIT TO SOUTHLAND CORPORTATION TO OPERATE GASOLINE PUMPS (AUTOMOTIVE SERVICE STATION) AT THE EXISTING 1400 EFFINGHAM STREET, 7-ELEVEN FOOD STORE. WHEREAS, Southland Corporation, by David N. Walker, Construction Coordinator Representative, made an application oursuant to ~ 40-70 (b) of the Code of the City of Por~o~h~ 1973, for~the gr~ntfng of~a~e?perm~-~s~e~einafter~describ~d; and the their ~HEREAS, the applicant and the Planning Director have done all things reqnired to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injorious to the property or improvements in the neighborhood; and (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. 2. Southland Corporation is hereby granted a use permit pursuant to ~40-70 (b) of the Code of the City of Portsmouth, Virginia to install and operate gasoline pumps for the retail sale of gasoline on the property described as follows: Beginning at the northwest corner of Effingham Street and Duke Streets; thence west along the north righ~-O.£r~gy of Duke Street 105'; thence north 137.32'; thence southeast 5.73'; thence north 101.96 to the south right-of-way of Scott Street; thence east along said right-of-~way 100' to the west right-of -way of Effingham Street; thence south along said right-of-way to the north r~ght-of-way of Duke Street, the_point of origin. UP282-15 3. The fcllowing conditions are prescribed for this use permit: (a) The Southland Corporation shall submit a site plan showing landscaping, appropriate fencing, and the location of all litter receptacles, which site plan must be approved by the Department of Planning. Prior to commencement of the gasoline retailing business, all improvements shown on the site plan as approved by the Planning Department, must be installed D~.~fi~dJsite plan specifications. (b) The applicant shall comply with all statutes, ordinances, policies and regulations of state and local governments that may be applicable to gasoline retailing sales and shall have obtained all necessary licenses and permits required for this use. Gordon Wheatley representing Portsmouth Redevelopment Housing Authority was available for questions from Council if necessary. On motion of Mrs. Webb and seconded by Mr. Gray the petition was approved, and by unanimous vote.
