Walker, Construction Coordinator <br /> Representative, made an application oursuant to ~ 40-70 (b) of the Code of the City of <br /> Por~o~h~ 1973, for~the gr~ntfng of~a~e?perm~-~s~e~einafter~describ~d; <br /> and <br /> <br /> the <br />their <br /> <br /> ~HEREAS, the applicant and the Planning Director have done all things reqnired <br />to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of said use <br />permit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> 1. That the use for which the use permit hereinafter-described is sought: <br /> <br />(a) Will not adversely affect the health and <br /> <br />safety of persons residing or <br /> <br />working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injorious to the property or <br />improvements in the neighborhood; and <br /> <br /> (c) Will be in accord with the purposes of the Zoning Chapter of the City <br />Code. <br /> <br /> 2. Southland Corporation is hereby granted a use permit pursuant to ~40-70 (b) <br />of the Code of the City of Portsmouth, Virginia to install and operate gasoline pumps <br />for the retail sale of gasoline on the property described as follows: <br /> <br /> Beginning at the northwest corner of Effingham Street and Duke Streets; <br />thence west along the north righ~-O.£r~gy of Duke Street 105'; thence north <br />137.32'; thence southeast 5.73'; thence north 101.96 to the south right-of-way <br />of Scott Street; thence east along said right-of-~way 100' to the west right-of <br />-way of Effingham Street; thence south along said right-of-way to the north <br />r~ght-of-way of Duke Street, the_point of origin. UP282-15 <br /> <br />3. The fcllowing conditions are prescribed for this use permit: <br /> <br /> (a) The Southland Corporation shall submit a site plan showing landscaping, <br />appropriate fencing, and the location of all litter receptacles, which site plan must <br />be approved by the Department of Planning. Prior to commencement of the gasoline <br />retailing business, all improvements shown on the site plan as approved by the Planning <br />Department, must be installed D~.~fi~dJsite plan specifications. <br /> <br /> (b) The applicant shall comply with all statutes, ordinances, policies and <br />regulations of state and local governments that may be applicable to gasoline retailing <br />sales and shall have obtained all necessary licenses and permits required for this <br />use. <br /> <br /> Gordon Wheatley representing Portsmouth Redevelopment Housing Authority was available <br />for questions from Council if necessary. <br /> <br /> On motion of Mrs. Webb and seconded by Mr. Gray the petition was approved, and by <br />unanimous vote. <br /> <br /> <br />
