Lovingood, Pastor of Cradock Presbyterian Church, opened the meeting <br />with prayer, followed by the Pledge of Allegiance to the Flag. <br /> <br />Mayor Johansen welcomed all vistors in attendnance. <br /> <br /> Motion of Mr. Beamer, and seconded by Mr. Gray, the <br />October 26, 1982; and, the regular meeting of October 26, <br />and was adopted by unanimous vote. <br /> <br />minutes of the called meeting of <br /> 1982, to be approved as received <br /> <br />UNFINISHED BUSINESS <br /> <br />Consent Agenda <br /> <br /> Agenda Items 82-361(g) UP 82-18, 82-120(g) UP 82-8, 82-378, 82-379, ~nd 8~7380, approved <br />on first reading at the October 26, 1982, regular meeting were taken up and read. Mayor <br />Johansen asked that Item 82-361(g) UP82-18 be removed from the consent agenda, on request <br />from Petitioner that the Item be deleted. <br /> <br />On motion of Mrs. Webb and seconded by Mr. Gray Agenda Ita~s~ <br /> <br />82=128(g]~Up,-82~8 82-378, <br /> <br />82- 20(g) <br /> <br />"A' RESOLUTION GRANTING A USE PERMIT TO NEW BETHEL BAPTIST CHURCH TO OPERATE A <br />CHILD DAYCARE CENTER AT 4212 GREENWOOD DRIVE. <br /> <br /> WHEREAS, New Bethel Baptist Church by Lenora S. White, Director, made an application <br />pursuann to Section 40-7S(b) of the Code of the City of Portsmouth, Virginia, 1973, for the <br />gr~nting of a use permit as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be done <br />in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. Thatithe use for which the use permiz hereinafter is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working mn <br />the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the Fublic use or injurious to the property or improveme <br />in the neighborhood; <br /> <br />(c) Will be ~n accordance with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. New Bethel Baptist Church is hereby granted a use permit pursuant to Section 40-75(b) <br />of the City Code to operate a child daycare center at the property described as follows: <br /> <br /> Beginning at the northwest intersection of Greenwood Drive and Clay Street; thence <br />north along the west right-of-way of Clay Street 160' + to a point; thence west 167.48'; <br />thence north 86.77'; thence west 170' to the east righ~-of-way of Tazewell Street; thence <br />south along said right-of-way 240' + to the north right-of-way of Greenwood Drive; thence <br />east along said right-of-way to Cla~ Street, the point of origin. (UP-82-8) <br /> <br />3. The use permit is approved subject to the following conditions: <br /> <br /> (a) That no more than forty (40) children will be cared <br />one time and will be limited to children between the ages of two <br />(6) years. <br /> <br />for in this facility at any <br />and one-half (2-1/2) to six <br /> <br /> (b) The <br />of 6:00 A. M. to <br />hours of 8:00 A. <br />at any one time. <br /> <br />interior operations of this facility will be conducted only between the hours <br />6:00 P. M.. The exterior playyard facilities will only be used between the <br />M. to 6:00 P. M. and will be limited to twenty (20) children in the playyard <br /> <br /> (c) The play area shall be between the new and old church buildings, which will be not <br />less than three thousand, five hundred twelve (3,512) square feet as shown on the attached site <br />plan, and will be enclosed on both the north and south ends by a masonry wall or solid wood <br />fence at least five (5) feet in height and have a three (3) foot wide exit gate located on both <br />the north and south ends. <br /> <br /> (d) The applicant shall comply with all codes, ordinances, policies and regulations <br />the federal, state and local governments that may be applicable, a~d shall have obtained all <br />necessary state and local licenses and permits required for this use. <br /> <br />of <br /> <br />tS <br /> <br /> <br />
