<br /> HOME WITHIN HER RESIDENCE AT 103 HARRIS ROAD.

<br /> WHEREAS, Mrs. Carin Fabricius has made
<br />of the City of Portsmouth, Virginia, 1973,
<br />described; and
<br />
<br />an application pursuant to g40.75 (b) of the Code
<br />for the granting of a use permit as hereinafter-
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things required to be done
<br />in connection with said application; and
<br />
<br />the neighborhood
<br />
<br />WHEREAS, the Planning Commission has recommended the granting of said use permit.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br />1. That the use for which the use permit hereinafter-described is sought:
<br />
<br /> (a) Will not adversely affect the health and safety of persons residing or working in
<br /> of the proposed use;
<br />
<br /> (b) Will nol be detrimental to the public use or injurious to the property or improve=~
<br />ments in the neighborhood; and
<br />
<br /> (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code.
<br />
<br /> 2. Mr. Carin Fabricius is hereby granted a use permit pursuant to ~40.75 (b) of the Code
<br />of the City of Portsmouth, Virginia to operate a nursing home at the property described as
<br />fotlow~

<br /> Beginning at the southwest intersection of Dahlgren Avenue and Harris Road; thence
<br />south along the west right-of-way of Harris Road 99.96'; thence west 79.27'; thence
<br />north 9OJ~to the south right-of-way of Dahlgren Avenue; thence east along said right-
<br />of-way 9]'~96~ to Harris Road, the point of origin. Said parcel contains 8,608 square
<br />feet more or less and is located in the Cradock Neighborhood.
<br />
<br />3. This use permit is approved subject to the following conditions~
<br />
<br /> 1. No more than five (S) ambulatory persons who are aged, infirmed, or disabled may
<br />be provided care in this home at any one time.
<br />
<br /> 2. The applicant must obtain the applicable licenses from the state for a home for
<br />adults and meet all building, fire and health code requirements.
<br />
<br />3. There shall be no advertising or business signs on the premises.
<br />
<br /> 4. The use permit is issued to Mrs. Carin Fabricius for 103 Harris Road and is not
<br />transferrable to any other person, entity or location."
