<br />"A RESOLUTION GRANTING APP~ROVAL FOR A GROUPi HOUSING PROJECT PURSHANT TO SECTION
<br />40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, AS ~¥1ENDED, SAID
<br />PRBJECTiiBEING KNOWN AS "SANDIE POINT" AND DESIGNATED AS GHP-83-1.
<br />
<br /> WHEREAS, Donald H. Sandie has made
<br />the City of Portsmouth, Virginia, 1973,
<br />Housing Project for the construction of
<br />ment known as "Sandie Point"; and
<br />
<br />application pursuant to Section 40-55 of the Code of
<br />as amended, for the granting and approval of a Group
<br />a fifty-three (53) unit townhouse/ condominium develo
<br />
<br /> WHEREAS, the application has been determined by the Planning Commission to have met the
<br />requirements of Section 40-55 of the Code of the City of Portsmouth, Virginia, 1973, as amend
<br />ed; and
<br />
<br /> WHEREAS~ the Planning Commission has reviewed such application and site plans submitted,
<br />therewith and has recommended approval of said application; and
<br />
<br /> WHEREAS, the developer has been informed that the approval of the Group Housing Project
<br />pursuant to said Section 40-55 grants only an exemption from certain requirements for resi-
<br />dences as stated in said section and does not constitute a waiver of any other requirement
<br />embodied in the Subdivision Ordinance, Zoning Ordinance, the Code of the City of Portsmouth,
<br />any other applicable local, state, or federal laws or regulations; and
<br />
<br /> WHEREAS, the developer is aware that building permits or any other required permit will ~
<br />issued only upon compliance with the ordinances, laws, or regulations applicable thereto; and
<br />
<br /> WHEREAS, the developers have proffered certain terms and conditions for the condominium
<br />proposal, and this City Council has considered such terms and conditions together with the
<br />recommendation of the City Planning Commission.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the certain Group Housing Project known as "Sandie Point" and designated as GHP-83-4, and more
<br />specifically shown on plans and the outline specifications prepared by the Office of Dan E,
<br />Griffin, Kenneth M. Sedlacko, designated 8252 dated February, 1983, and filed with the ap-
<br />propriate officials of the City of Portsmouth, Virginia and made a part hereof, is hereby
<br />granted approval subject to the following terms and conditions as proffered by the developer b
<br />a letter dated March 15, 1983:
<br />
<br /> 1. That no more than fifty-three (53) townhouse/ condominium units will be built on this
<br /> site and that all units will sell in excess of $75,000.;
<br />
<br /> 2. That all of the streets, utilities and maintenance services will be the respo~sibilit
<br />of the developer and the condominium association;
<br />
<br /> 3. That recreational facilities will be included in the form of common open areas.
<br />Passive recreation will be offered in the form of a walking trail from Sandie Point Road to a
<br />along the proposed bulkhead along the waterfront as well as an open green area in the center
<br />the development. Active recreation will be offered through the development of the abandoned
<br />railroad trestle into a pier and boat slip facility for Sandie Point residents. Twenty (20)
<br />thirty (30) boat slips will be provided which will be built either on floating docks or fixed
<br />piers and such boat slips would be joined by way of a ramp and stairway connection to the
<br />railroad trestle. The trestle would further be used for such other recreational purposes as
<br />fishing, sunbathing, etc.. The trestle walkway will be decked to provide a suitable walkway an
<br />railings, as necessary for safety;
<br />
<br /> 4. A final landscape plan shall be submitted to the Office of Planning for the City of
<br />Portsmouth for review and approval by the City Planning staff prior to the issuance of any
<br />building permits.
<br />
<br /> 5. The condominium will be governed under the condominium laws of Virginia and a site pie
<br />for the condominium conforming to the specifications required by Section 55-79.58 of the Code
<br />of Virginia shall be filed with the appropriate City officials;
<br />
<br /> 6. The developer shall resurface Locust Lane to twenty-four (24) feet wide and the length
<br />of approximately four hundred C400) feet from the development site to Windsor Road. The cost
<br />of this resurfacing and the maintenance and upkeep of this section of Locust Lane will be the
<br />responsibility of the developer and the condominium association for all times in the future.
<br />
<br /> 7. Additionally, the developer shall resurface an additional portion of Windsor Road not
<br />to exceed 75 linear feet to 24 feet wide; however, future upkeep and maintenance of this ad-
<br />dition will not be deemed a responsibility of the developer and/or the condominium association
<br />

<br /> 83-134 Rn~ordinance to amend the Code, by amending Sections 37-1, 37-2, 37-22, 37-24,
<br />37-25, 37-29, 37-38, 37-39, and 37-50, pertaining to taxicabs, deferred from the meeting of
<br />April 12, 1983, was taken up:
<br />
<br /> The City Manager presented the following letter: ~
<br /> "At your last Council meeting you deferred action on the proposed Taxicab Ordinance until
<br />such a time that the proposed code changes could be shared with them. The letter has sinne
<br />been mailed to all taxicab owners and operators listing the proposed changes along with a brie
<br />explanation. Attached is a copy of the letter.
