<br />. All that certain piece or parcel of land, lying and being in the City of Portsmouth,
<br />Virginia, and comprising that portion of an unnamed street as shown on the plat entitled
<br />"Plat Showing 30 Foot Unnamed Street And 10 Foot Widening Strip To Be Closed For Ports-
<br />~k ReDevelopment And Housing Authority", prepared by the Engineering & Technical
<br />Services Department of the City of Portsmouth, Virginia, dated August 31 1982 a copy

<br />on-going survey coordinated by the LegaJ Analyst in the City Attorney's office and in conjunc-
<br />tion with the Parks and Recreation Department and the Planning Department, as well as other ap-
<br />plicable City Departments, to detdrmine what paper streets may be closed. In accordance with
<br />the results of this survey, the office of the City Attorney initiated a petition to close a
<br />portion of Academy Avenue.
<br />
<br /> At its meeting of April 5, 1983, the Planning Commission voted to recommend that the City
<br />Council defer this matter until such time as a study of the Ebony Heights' neighborhood has
<br />been completed. In aczordanae with the State law, a request for the appointment ov viewers
<br />has been advertised, and the attached resolution prepared by the office of the City Attorney
<br />is presented for consideration by City Council.

<br /> The City Attorney has advised that there are three options available to the City Council:
<br />
<br /> 1. Appoint the viewers in accordance with the State taw to render a report as to
<br /> whether in their opinion, any, and if any, what, invonvenien~e would result from
<br /> the street closure;
<br />
<br />Decline to appoint the viewers and the matter can be
<br />Commission upon application by the City or any other
<br />upon completion of the Ebony Heights' study, which is
<br />mately 1 year from now;
<br />
<br />reconsidered by the Planning
<br />adjoining property owners

<br /> 3. Defer the mazter pending completion of the study at whizh time same can be brought
<br /> back to Council for consideration of the appointment of viewers; provided, however,
<br /> that if an excessive period of time has elapsed a new advertisment of Council's
<br /> conside~atzon will be required. '

<br /> The appropriate notice to the citizens of the consideration by Council have been forwarde~
<br />and the attached correspondence has been received in favor of closing.
<br />
<br /> While tbs closing of the street would appear to be the appropriate action to be taken,
<br />in view of the anticipated study of the Ebony Heights' neighborhood, which may result in re-
<br />organization of streets.and lots, it would be best to deny appointment of viewers at this time
<br />with the understanding that this matter will be brought back to the City Council for considera-
<br />tion a part of the Ebony Heights' study.

<br /> On motion of Mr. Beamer and seconded by Mr. Holley, the following resolution was adopted,
<br />and by the following vote: ~

<br /> "A RESOLUTION APPOINTING VIEWERS FOR THE CLOSING OF A PORTION OF ACADEMY AVENUE.
<br />
<br /> WHEREAS, the City of Portsmouth has made application to vacate, close and discontinue the
<br />hereinafter-described portion of Academy Avenue, and it appearing that notice of application
<br />and request for the appointment of viewers has been duly advertised as required by law.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that A
<br />N. Kendrizk, J. R. Wilkerson, Howard L. Davis, George N. Powers, Sr. and C. L. Knight be
<br />pointed viewers and that H. G. Hariston and C. E. Ellis be appointed alternate viewers in the
<br />ev~n~ one'of_thb pyecedih~ viewers fails to participate, said vxewers to view the hereinafter-
<br />described portion of such street and to report to this Council in writing whether in their
<br />opinion any, and if any, what inconvenxence would result in the vacating and closing of the
<br />following:

<br /> All that portion of Academy Avenue between Campbell Street on the north and
<br />Churchland Boulevard on the south. (~-83-2)"

<br />the approval and payment of interest on certain lost or destroyed interest couoons of the City
<br />of Portsmouth.

<br /> 'The Federal Reserve Bank of Richmond and Commercial Union Insurance Company have notifie
<br />the City that certain interest coupons have eiZher been lost or destroyed providing a list of
<br />same as ms shown on the attacheJ resolution. The Code of Virginia provides for the replacemen
<br />of lost or destroyed bonds and the interest coupons and payment of such interest coupons upon
<br />
