May 24, 1983 <br /> <br /> "A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION <br /> 40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, AS AMENDED, SAID <br /> PROPERTY BEING KNOWN AS VICTORIAN SQUARE AND DESIGNATED AS GHP-83-2. <br /> WHEREAS, Castle Development Corporation, for Victcrian Square Associates, has made appli <br />cgtion pursuant~to Section 40-55 of the Code of the City of Portsmouth, Virginia, 1973, as <br />amended, for the granting and approval of a Group Housing Project known as Victorian Square <br />at 401 and 403 Maryland Avenue; and <br /> WHEREAS, the application has been determined by the Planning Commission to have met the <br />requirements of Section 4C-55 of the Code of the City of Portsmouth, Virginia, 1973, as amend- <br />ed; and <br /> WHEREAS, the Planning Commission has reviewed such application and site plans submitted <br />therewith and has recommended approval of said application; and <br /> WHEREAS, the developer has been informed that approval of the Group Housing Project pur- <br />suant to said Section 40-55 grants only an exemption from certain requirements for residences <br />as stated in said section and does not constitute a waiver of any other requmrement embodied : <br />the Subdivision Ordinance, Zoning Ordinance, the Code of the City of Portsmouth, or any other <br />applicable local, state or federal laws or regulations; and <br /> WHEREAS, the developers are aware that building permits or any other required permit will <br />be issued only upon compliance with the ordinances, laws or regulations applicable thereto. <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that t~ <br /> certain Group Housing Project known as Victorian Square and designated as 5HP-83-2 and more <br /> specifically shown on plans prepared by Castle Developers consisting of a site plan, exterior <br /> elevation plan and floor plan and filed with the appropriate officials of the City of Ports- <br /> mouth, Virginia and made a part hereof, is hereby granted approval subject to an amendment to <br /> the floor plan in order that the minimum required floor area for each dwelling unit, exclusive <br /> of garages and patios, be six hundred (600) square feet." <br /> <br />Ayes: Beamer, Gray, Holley, Webb, Johansen <br />Nays: None <br />Abstaining: Whitlow <br /> <br /> (d) GHP 83-3 Resolutxon granting approval for a group housiBg project pursuant to <br /> Section 40-55 of the code said project being know as Olde Towne Condomium: <br /> and designated as GHP 83-3, ap~d?on~fi~st~eading~t the Pub~ic~Heari~ <br /> held on May 10, 1983 by 6-0-1 vote. <br /> On mction of Mr. Gray and seconded by Mr. Beameri the following resolution waaadopted, <br />and by the following vote: <br /> "A RESOLUTION GRANTING APPROVAl FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION <br /> 40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, AS AMENDED, SAID <br /> PROJECT BEING KNOWN AS OLDE TOWNE CONDOMINIUMS AND DESIGNATED AS GHP-83-3. <br /> WHEREAS, Castle Development Corporation has made application pursuant to ~40~55 of <br />the Code of the City of Portsmouth, Virginia, 1973, as amended, for the granting and appro- <br />val of Group Housing Project known as Olde Towne Condominiums;
