305 May 24, 1983 At a regular meeting of the City Council held on May 24, 1983, there were present: J. E. Johansen, J. Robert Gray, James Mo~ton V. Whitlow, George L. Hanbury, City Attorney. W. Holley, III, Gloria O. Webb, City Manager, Steven Lieberman, Absent: Jack P. Barnes Rev. Vernon A. Battle, of Trinity Baptist Church, open'ed the meeting with prayer, followed by the Pledge of Allegiance to the Flag. Mayor Johansen welcomed all vistors in attendance, and a special welcome to students from Waters Jr. High Schoo~ and their~teachers, Mrs. Wheaton and M~s. Hill. Motion of Mrs. Webb and seconded by Mr. Gray, minutes of the called meeting of May 10, 1983 minutes of the regular meeting of May 10, 1983; minutes of a ca~led2mmeting~of May 16, 1983; and a special meeting of May 16, 1983, to be approved as received, and was adopted by unanimous vote 83-200 Public Hearing on proposed adoption of resolution providing for amendment to the Articles of Incorporation of the Southeastern Public Service Authority of Virginia was held. No one spoke. UNFINISHED BUSINESS Consent Agenda On motion of Mrs. Webb and seconded by Mr. Whitlow, the following Agenda Items 83-172 (e), (f), 83-174, 83-175, and 83-176 approved on first reading at the Council Meeting of May 10, 1983 were adopted by the following Fore: ~S~172 Amendments to the Code: "AN ORDINANCE TO AMEND CHAPTER 33 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA 1973, BY ADDING THERETO SECTION S3-36.1 PERTAINING TO STREET RIGHT-OFrWAY DEDICA- TION,'' (f) "AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY AMENDING SECTION 40-210(b) PERTAINING TO THE BOARD OF ZONING APPEALS." 83-174 "AN ORDINANCE TO APPROPRIATE $17,399.00 FROM THE CAPITAL IMPROVEMENT FUND FOR REPAIRS IN THE PUBLIC RIGHT-OF-WAY IN THE CHURCHLAND NORTH SUBDIVISION." 83-173 "AN ORDINANCE TO APPROPRIATE $158,000. FROM THE PUBLIC UTILITY CAPITAL IMPROVEMENT FUND FOR THE HATTONSVILLE STREET AND UTILITY PROJECT." 83~176 "AN ORDINANCE TO APPROPRIATE $191,065. FROM THE GRANTS CONTINGENCY FUND FOR THE DRUG/SUPPRESSION HABITUAL OFFENDER PROGRAM." Ayes: Beamer, Gray, Holley, Webb, Whitlow, Johansen Nays: None Other Items Under Unfinished Business: 83-172 Use Permit and Group Honsing Project Applications: (a) Use Permit U~ 83-3 Application of Faith Deliverance Center, by Pastor Olive C. Brown for a church at 608 Effingham Street, deferred from the Public Hearing of May 10, 1983. Motion of Mr. Holley and seconded by Mrs. Webb ~o suspend the rules for Bishop Brown and Mrs. Brown to speak, as they did not sign a card to speak. Bishop Brown and Mrs. Brown spoke in support of the application. Motion of Mr. Holley and seconded by Mrs. Webb to defer the matter to June 28, 1983, Council meeting ~n order to get a reporn on the P.R.H.A. Plan for that area, was adopted ~y S-1 (Nay-Beamer) vote. (b) Use Permit UP 83-4 Application of Max Markman, by Pastor Clarence H. Singetary, for a church service cen~er at 439 Effingham Street, deferred from the Public Hear±~g of May !0, 1983. Rev. C. H. Singletary, 110 Baldwin Ave., spoke in favor sf the application. Motion of Mrs. Webb and seconded by Mr. Holley to defer the matter to June 28, 1983, Council meeting in order to get a report on the P.R.H.A. Plan for that area, was adopted by S-1 (Nay- Beamer) vote. by (c) GHP 83-2 Resolution granting approval for a group housing project pursuant to Section 40-SS of the code, said property being known as Victorian Square and designated as GHP 83-2,a!~fo~ed,on f if~t reading at~the_~ablic Hearing o~ M~y 10, 1983, b~ 6-0-1 v6t~.
