351 <br /> <br />July 26, 1983 <br /> <br /> 83~289 Letter from the City Manager recommending adoption of an ordinance to amend <br />Section 11~108 of the City Code pertaining to the Public Procurement Act. <br /> <br /> "The proposed ordinance on your Agenda to amend Section 11-108 of the City Code <br />pertaining to bidding of construction contracts for new construction or modification of <br />public facilities is required due to recent amendments of the State Code approved by the <br />1983 General Assembly. These changes would require competitive bidding or negotiation for <br />such contracts if State funds were being used in an amount of $10,0OO or more. The previous <br />requirement was for State funds ~n an amount of $100,000 or more. <br /> <br /> The second change provides that anyone who has been engaged on the project as architect <br />or engineer could not also receive the construction contract award even if the construction <br />contract and the engineering contract were under separate agreements. <br /> <br />I recommend approval~of this ordinance. <br /> <br />on <br /> <br /> On motion of Mr. Whitlow and seconded by Mrs. Webb, the following ordinance was adopted <br />first and final reading, and by the followings'vote: <br /> <br />"AN ORDINANCE TO AMEND SECTION 11-108 OF THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, PERTAINING TO CONTRACTS FOR CONSTRUCTION OR ALTERATION OF BUILDINGS." <br /> <br />Ayes: Barnes, Beamer, Gray, Webb, Whitlow, Johansen <br />Nays: None <br /> <br /> 83-290 Letter from the City Manager recommending adoption of a resolution to provide <br />that the Mayor and Members of City Council shall be included as employees of the City pursuant <br />to the ~erms of the Virginia Workers· Compensaton Act. <br /> <br /> "The 1983 General Assembly adop~eRd legislation that allows governing body of the City <br />to be included as employees under the Firginia Workers' Compensation Act. Adoption of the <br />attached resolution would extend the benefits of the Virginia Workers' Compensation Act to <br />the Mayor and Members of Council pursuant to the terms and conditions of said Act. <br /> <br />I recommend adoption of the attached resolution." <br /> <br /> On motion of Mrs. Webb and seconded by Mr. Whitlow, the following resolution was adooted, <br />and by the following vote: ~ <br /> <br />"A RESOLUTION TO PROVIDE FHAT THE MAYOR AND MEMBERS OF COUNCIL OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, SHALL BE INCLUDED AS EMPLOYEES OF THE CITY PURSUANT TO <br />THE TERMS OF THE VIRGINIA WORKERS' COMPENSATION ACT. <br /> <br /> WHEREAS, Section 65.1-4, Code of Virginia, 1950, <br />provides that the governing body of the City may, by <br />its members included as employees under the Virginia <br /> <br /> as amended by the 1983 General Assembly, <br />resolution duly adopted, elect to have <br />Workers' Compensation Act; and <br /> <br /> WHEREAS, the Council of the City of Portsmouth deems it appropriate that the benefits <br />of the Virginia Workers' Compensation Act be extended to the Mayor and Members of Council <br />pursuant to the terms .and conditions of said Virginia Workers' Compensation Act. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginxa, <br />that from and after the date of the adoption of this resolution the Mayor and Members of <br />Council of the City of Portsmouth, Virginia, shall be included as employees of the City <br />pursuant ~o the terms and conditions of the Virginia Workers' Compensation Act." <br /> <br />Ayes: Barnes, Beamer, Gray, Webb, Whitlow, Johansen <br />Nays: None <br /> <br /> 83-291 Letter from the City Manager~'recommending adoption of a resolution creating a <br />study committee on cl~urch owned property. <br /> <br /> "AS we have discussed on numerous occasions, there has been a surprising increase in the <br />number of churches in the City. Since 1979 the number has risen from 165 to more than 300. <br />Many of the most recent churches have been "store front"churches located in areas of the City, <br />targeted for redevelopment and revitalization. <br /> <br /> Because of the complexity of this subject, it is recommended that the Council appoint a <br /> study committee to evaluate the affects of church-cnvned properties on the City. It is sug- <br />.gested that the make up of the Committee be as follows: <br /> <br />o two members of the Planning Commission, <br /> <br />o three representatives of religious institutions, and <br /> <br />o two citizens at large. <br /> <br /> If Council¢~m~urs in concept with this approach the City Attorney will have a resolution <br />for Council action Tuesday evening providing for the establishment of such a study comm%~en"! <br /> <br /> On motion of Mrs. Webb and seconded by Mr. Barnes, the following resolution was adopted, <br />and by the following vote: <br /> <br /> <br />
