Beamer, Sr., J. Robert Gray, Gloria O. <br />Webb, Morton V. Whitlow, George L. Hanbury, City Manager, Steven Lieberman, <br />City Attorney. <br /> <br />Absent: James W. Holley, III <br /> <br /> Rabbi Judah L. Fish, Gomley Chesed Congregation, opened the meeting with prayer, followe <br />by the Pledge of Allegiance to the Flag. <br /> <br />Mayor Johansen welcomed all visitors in attendance. <br /> <br /> Motion of Mr. Beamer.and seconded by Mr. Gra~, mmnutes of the called meeting of July ]2, <br />1983 and minutes of the reguRar meeting of July'%21~ 1983, to be approved as received, and was <br />adopted by unanimous vote. · <br /> <br /> 83-284 --Mayor Johansen presented to R'oy W. Cherry, Director of Finance and Darrell H. <br />DiVito, Senior Accountant, an Award of Financial Reporting Achievement for recognition in <br />governmental accounting and financial reporting by the Municipal F~nance Officers~Association <br />of the United States and Canada. <br /> <br />UNFINISHED BUSINESS <br /> <br />Consent Agenda <br /> <br />83-266 Rezoning, use permit, group housing and parking variance applications: <br /> <br /> On motion of Mrs. Webb and seconded by Mr. Barnes, the following Agenda <br />(f),(g),(h), and (i) approved on first reading at the Public Hearing of July <br />adopted by the following vote: <br /> <br />Items (c),(d),(e] <br />12, 1983, were <br /> <br />(c) "ZONING AMENDMENT ORDINANCE 2 83-10" <br /> <br />(d) "ZONING AMENDMENT ORDINANCE Z 83-11- <br /> <br />(e) <br /> <br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION <br />40-SS OF THE CODE OF tHE CITY OF PORTSMOUTH, VIRGINIA, 1973, AS AMENDED, SAID <br />PROJECT BEING KNOWN AS "ELIZABETH LANDING" AND DESIGNATED AS GHP-83-S. <br /> <br /> WHEREAS, Michael Rowe, developer, on behalf of Dorm B. Jackson, owner, has made applica- <br />tion pursuant to ~40,~5 of the Code of the City of Portsmouth, Virginia, 1973, as amended, <br />the granting and approval of a group housing project for the construction of an eight (8) unit <br />townhouse~condominium development known as "Elizabeth Landing"; and <br /> <br /> WHEREAS, the application has been determined by the Planning Commission to have met the <br />requirements of §405S of the Code of the City of Portsmouth, Virginia, 1973, as amended; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such application and site plans submitted <br />therewith and has recommended approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that the approval of the group housing prosect <br />pursuant to said §40=5S grants only an exemption from certain requirements for residences as <br />stated in said section and does not constitute a waiver o£ any other requirement embodied in <br />the Subdivision Ordinance, the Zoning Ordinance, the Code of the City of Portsmouth, or any <br />other applicable local, state or federal laws or regulations; and <br /> <br /> WHEREAS, the developer is aware that the building permits or any other required permit <br />will be issued only upon compliance with the ordinances, laws, or regulations applicable there <br />and <br /> <br /> WHEREAS, the developers have proffered certain terms <br />proposal, and this City Council has considered such terms <br />commendations of the City Planning Commission. <br /> <br />and conditions <br />and conditions <br /> <br />for the condominium <br />together with the re- <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that th <br />certain group housing project known as "Elizabeth Landing" and designated as GHP-83-S and more <br />speci£icially shown on the plans and outline specifications filed with the appropriate offi- <br />cials of the City of Portsmouth, Virginia on May 16, 1983 and made a part hereof, is hereby <br />granted approval subject to the terms and conditions contained on said plans and outline <br />specifications." ~ <br /> <br />to <br />use permit <br /> <br /> "A RESOLUTION GRANTING A USE PERMIT TO NOTTINGHAM HOMES, LTD.
