<br /> WHEREAS, the City has not been able to pUrchase the property described herein, necessary
<br />to the project, because the owners thereof and the City have not been able to agree upon the
<br />price to be paid therefor; and

<br /> WHEREAS, advancement of the work and use of said property will be unreasonably delayed
<br />if said property is not made available for the project as soon as possible.

<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:

<br /> That the City Attorney be, and he hereby is, directed to institute eminent domain pro-
<br /> ceedings against the hereinafter-described property situated in the City of Portsmouth,-
<br /> Virginia~'~for"the'purpose of acquiring fee simple title~ th~rei~.~ogethe~ith:ia~ ~nd%all
<br /> easements of access, light or air incident to the lands of the landowner abutting upon said
<br /> property, in-accordance with, and pursuant to, ~2.06, 2,07 and 2.08 of the Charter of the
<br /> City of Portgmouth, Virginia, as amended, and to deposit to the credit of the Clerk of the
<br /> Circuit Court of the City of Portsmouth as provided by law the sum hereinafter specified-to
<br /> compensate the owners of the property designated as Parcel~095 on;that certain ptat entitled
<br /> ~Plat Sh~wing Proposed'R~ght~of-Way, Expansion.For West Norfolk Road", dated July 11, 1983,
<br /> prepared by the Engineering & Technical Services Department of the City of Portsmouth, Virgini~
<br /> recorded in the Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia, in
<br />Book 12, pages 68 through 71, both inclusive.
