<br /> WHEREAS, the Council of the City of Portsmouth has determined it to be in the public
<br />interest to reconstruct, alter and widen West Norfolk Road; and
<br />
<br /> WHEREAS, the City has found it necessary to acquire the fee simple interest in and to the
<br />hereinafter-described parcel of land situated in the City of Portsmouth, Virginia, for the sai
<br />purpose o£ reconstructing, altering and widening West Norfolk Road; and
<br />
<br /> WHEREAS, the City has not been able to purchase the property described herein, necessary
<br />to th~ pmO.j~ect, because the owners thereof and the City have not been able to agree upon the
<br />price to be paid therefor; and
<br />
<br /> WHEREAS, advancement of the work and use of said property will be unreasonably delayed
<br />if said p'roperty is not made available for the project as soon as possible.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br /> That the City Attorney be, and he hereby is, directed to institute eminent domain pro-
<br />ceedings against the hereinafter-described property situated in the City of Portsmouth,
<br />Virginia, for the purpose of acquiring fee simple title therein, together with any and all
<br />easements of access, light or air incident to the lands of the landowner abutting upon said
<br />property, in accordance with, and pursuant to, ~2~06~2.87 ~nd~'2.08 of the Charter of the
<br />City of Portsmouth, Virginia, as amended, and to deposit to the credit of the Clerk of the
<br />Circuit Court of the City of Portsmouth as provided by law the sum hereinafter specified to
<br />compensate the owners of the property designated as Parcel 049 on that certain plat entitled
<br />"Plat Showings:PropoSed Right-of-Way Expansion For West Norfolk Road", dated July 11, 1983,
<br />prepared by the Engineering ~ Technical Services Department of the City of Portsmouth, Vir-
<br />ginia, recorded in the Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia
<br />mn Map Book 12, pages 68 through 71, both inclusive.
<br />
<br />The name of the property owner is: Clarke M. Thornton.
<br />
<br /> The amount to be deposited to the credit of the Clerk of the Circuit Court of the City
<br />of Portsmouth is: $8,700.00."
