August 23, 1983 <br /> <br /> WHEREAS, the Council of the City of Portsmouth has determined it to be in the public <br />interest to reconstruct, alter and widen West Norfolk Road; and <br /> <br /> WHEREAS, the City has found it necessary to acquire the fee simple interest in and to the <br />hereinafter-described parcel of land situated in the City of Portsmouth, Virginia, for the sai <br />purpose o£ reconstructing, altering and widening West Norfolk Road; and <br /> <br /> WHEREAS, the City has not been able to purchase the property described herein, necessary <br />to th~ pmO.j~ect, because the owners thereof and the City have not been able to agree upon the <br />price to be paid therefor; and <br /> <br /> WHEREAS, advancement of the work and use of said property will be unreasonably delayed <br />if said p'roperty is not made available for the project as soon as possible. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> That the City Attorney be, and he hereby is, directed to institute eminent domain pro- <br />ceedings against the hereinafter-described property situated in the City of Portsmouth, <br />Virginia, for the purpose of acquiring fee simple title therein, together with any and all <br />easements of access, light or air incident to the lands of the landowner abutting upon said <br />property, in accordance with, and pursuant to, ~2~06~2.87 ~nd~'2.08 of the Charter of the <br />City of Portsmouth, Virginia, as amended, and to deposit to the credit of the Clerk of the <br />Circuit Court of the City of Portsmouth as provided by law the sum hereinafter specified to <br />compensate the owners of the property designated as Parcel 049 on that certain plat entitled <br />"Plat Showings:PropoSed Right-of-Way Expansion For West Norfolk Road", dated July 11, 1983, <br />prepared by the Engineering ~ Technical Services Department of the City of Portsmouth, Vir- <br />ginia, recorded in the Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia <br />mn Map Book 12, pages 68 through 71, both inclusive. <br /> <br />The name of the property owner is: Clarke M. TION AUTHORIZING THE CITY MANAGER TO CONVEY CITY OWNED PROPERTY TO THE -,-~il <br /> INDUSTRIAL DEVELOPMENT AUTHORITY (LEE AVENUE AND INDUSTRIAL AVENUE). <br /> <br /> WHEREAS, the City of Portsmouth owns certain hereinafter-described property in the vicin- <br />ity of the Port area bounded on the west by Lee Avenue and on the east by Industrial Avenue; <br />and <br /> <br /> WHEREAS, the Industrial Development Authority has received a proposal from C. E. Willett <br />to develop said property for Port related business; and <br /> <br /> WHEREAS, said property is no longer needed by the City of Portsmouth for municipal pur- <br />poses and is, hereby, declared to be surplus;~and <br /> <br /> WHEREAS, th~:City council deems it to be in the best interest of the City that said prope <br />be developed for Port related b~siness activities; and <br /> <br /> WHEREAS, the value of said property has been established to be $18,260; and <br /> <br /> WHEREAS, the proposed developer has agreed to screen the property by using a suitable <br /> <br />~ty <br /> <br /> <br />
