WHEREAS, the application has been determined by the Planning Commission to have met the <br />requirements of §40-55 of the Code of the City of Portsmouth, Virginia, 1973, as amended; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such application and site plans submitted <br />therewith, and has recommended a conditional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of a group ho~using project pursuan <br />to §40-55 grants 0nly an exemption from certain requirements for residences as stated in said <br />section and does not constitute a waiver of any other requirement embodied in the Subdivision <br />Ordinance, Zoning Ordinance, the Code of the City of Portsmouth, Virginia, or any other appli, <br />cable local, state or federal laws or regulations; and <br /> <br /> WHEREAS, the developer is aware that building permits or any other required permit will b, <br />issued only upon compliance with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the certain group housing project known as Waters Edge Condominiums and designated as GHP-83-6 <br />more specifically shown on plans prepared by The Yates Group, dated October 10, 1983, and file~ <br />with the appropriate officials of the City of Portsmouth, Virginia, and made a part hereof, is <br />hereby granted approval subject to the following terms and conditions: <br /> <br /> (1) Detailed engineering drawings and utility system layouts must satisfy the Fire <br />Department and the Public Works Department. <br /> <br /> (2) A detailed landscaping plan must be submitted to the Planning Department for their <br />review and approval. Such landscaping should provide some vegetational screening along the <br />entry roadway and parking lot. <br /> <br /> (3) The project as shown on the noted site plan must be redesigned to provide a minimum <br />fifteen (15) foot setback as required by the City Code." <br /> <br />Ayes: Barnes, Beamer, Gray, Holley, Webb, Whitlow <br />Nays: None <br /> <br />83-404 (h) <br /> <br />- UF 83-25 :~ Res.ol6tio~ granting a use~permit:to the portsm6uth~Com~Unity~: <br /> Services Board to operate a group residence for Alcohol Rehabili- <br /> tation and Treatment Facility at 1000 Green Street, deferred from <br /> the meeting of November 22, 1983. <br /> <br /> The City Manager stated that the State has agreed to 18 months. However, an effort to <br />try to involve as much of the medical community as possible, a committee has been formed to <br />insure the medical community that there is no duplication to the indigent in the private secto <br />Consequently, I would recommend that the matter be deferred until January so we will fe~l com- <br />fortable with all those individuals involved. <br /> <br /> Motion of M~. Gray and seconded by Mrs. Webb, that UP 83-23 be deferred to the first <br />meeting in J~hna~y(10th), and was adopted by unanimous vote. <br /> <br /> 83-301(g) - The following ordinance approved on first reading at the meeting of November <br />22, 1983, was taken up and read: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY <br />AMENDING SECTIONS 40-51, 40-68(b), 40-68.1(e), 40-70(b), 40-71(b), 40-75(b), <br />40-74(b) 40-75(b), 40-76(b), 40-77(b), 40-78(b), 40-79(b), 40-121(a), PERTAINING <br />TO ADULT AND CHILD CARE FACILITIES." <br /> <br /> On motion of Mrs. Webb and seconded by Mr. Gray, the ordinance ~as adopted on final <br />reading, and by the following vote: <br /> <br />Ayes: Barnes, Beamer, Gray, Holley, Webb, Whitlow <br />Nays: None <br /> <br /> 83-434 Resolution approving issuance of Industrial Development Revenue Bonds by the <br />Industrial Development Authority for Farm Fresh, Inc., in an amount not to exceed $6,000,000 <br />for a shopping center facility at the intersection of George Washington Highway and Victory <br />Boulevard, deferred from the meeting of November 22, 1983. <br /> <br />The following letter ~eceived from the City Manager: <br /> <br /> "The Industrial Development Authority held a public hearing on December 12, 1983, and <br />approved the issuance of Industrial Development Revenue Bonds for Farm Fresh, Inc. in an amoun <br />estimated at $6,000,000 for the purchase of an improvements to property located in the William <br />Court area at the intersection of George Washington Highway and Victory Boulevard. In accord- <br />ance with the applicable federal and state law the IDA has requested City Council to approve <br />the issuance of such bonds. <br /> <br /> The intent of these bonds is to finance the acquisition of land, construction and equip- <br />ping of a 100,000 square feet farm fresh "Super Savin$ Center", and the construction of a <br />41,250 square feet commercial center. This property ms anticipated to return'in excess of <br />$750,000 per year in local property, sales, utility, and business license taxes. <br /> <br /> The attached resolution was deferred from the meeting of November 22, 1983, and I recom- <br />mend its approval." <br /> <br /> <br />
