<br /> WHEREAS, a copy of PRHA's resolution approving the issuance of said bonds, subject to the
<br />terms and conditions contained therein, and the appropriate certifications and documentations
<br />required by the applicable federal and state laws have been provided to the City Council for
<br />its consideration.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Portsmouth, Virginia,
<br />approves the issuance of multi-family housing revenue bonds by the Portsmouth Redevelopment am
<br />Housing Authority for Hampton Roads Investment Properties in an amount not to exceed Ten Milli~
<br />($10,000,000) Dollars to finance the cost of the acquisition, renovation, and equipping of the
<br />"Facility".
<br />
<br /> BE IT FURTHER RESOLVED that the Council of the City of Portsmouth, Virginia finds that in
<br />order to preserve, develop and protect safe and sanitary housing and promote a desirable
<br />economic mix that at least twenty percent (20%) of the units in each residential building will
<br />be rented or held available for persons of low income to the extent required pursuant to 636-1!
<br />of the Code of Virginia, 1950, as amended.
<br />
<br /> BE IT FURTHER RESOLVED that the approval of the issuance of the bonds as required by the
<br />applicable federal and state law does not constitute an endorsement of the bonds, financial
<br />viability of the "Facility" or the credi~ worthiness of Hampton Roads Investment Properties,
<br />but, as required by §25.1-1380 of the Code of Virginia, 1950, as amended, the bonds shall
<br />provide that neither the Commonwealth of Virginia, the City of Portsmouth nor the PRHA shall b~
<br />obti~g:ated to pay the bonds or the interest thereon or other costs incident thereto except from
<br />the revenues and monies pledged therefor, and neither the faith or credit of the taxing power
<br />of the Commonwealth, the City nor the PRHA shall be pledge thereto.
<br />
<br />This resolution shall take effect immediately upon its adoption."

<br />closure of a portion of an unnamed alley on the west side of Rodman Avenue.

<br /> "Robert C. Barclay, III, Attorney for Thomas C. Culpepper and others have made application
<br />to close a portion of an unnamed alley on the west side of Rodman Avenue. As required by law
<br />the~applicant has given the appropriate notice of application.
<br />
<br /> The attached resolution, if approved by City Council, appoints the~necessary viewers and
<br />requests their recommendation.

<br />and by the following vote:

<br />"A RESOLUTION APPOINTING VIEWERS FOR THE CLOSING OF AN UNNAMED ALLEY ON THE
<br />WEST SIDE OF RODMAN AVENUE.
<br />
<br /> WHEREAS, Robert C. Barclay, III, attorney for Thomas C. Culpepper, Robert B. Quinn, Jr.,
<br />John E. Parrish and Sol Soroko, has made application to vacate, close and discontinue the
<br />hereinafter-described portion of a certain street, and it appearing that notice of application
<br />and request for appointment of viewers has been duly advertised as required by law.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that A.
<br />N. Kendrick, Simon P. Arrington, Richard D. Ottavio, James V. McGhee, and Raymond Tweed be
<br />appointed viewers, and that Harrison Miller and C. L. Knight be appointed alternate viewers in
<br />the event one of the preceeding viewers fails to participate, said viewers to view the herein-
<br />after-described portion of such street and to report to this Council in writing whether in
<br />their opinion any, and if any, what inconvenience would result from vacating and closing the
<br />following:

<br /> That portion of the alley 10 feet in width shown on the plat of "Waterview",
<br />duly recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake,
<br />Virginia, in Map Book 17, pages 58 an& 59, running through the center of Block 4
<br />and along the western boundary of Block 4(A) on said plat which lies between a line
<br />drawn parallel to and distant 300 feet S. 34! 04' west from the eastern line of
<br />Rockbridge Road (formerly Loudoun Street) which line is the prolongation northward
<br />of the dividing line between Lots 13 and 14 in Block 4 of said plat of "Waterview",
<br />a~&:t~e:~west~side of Rodman Avenue as the same now exist after being recently
<br />widened i0 'feet. Said portion of the aforesaid alley is bounded by parcels 5 and
<br />9 on Tax Map 355, Parcel 1 on Tax Map 354 and an unnumbered parcel marked "City of
<br />Portsmouth" on both maps."
