<br /> 84-60 - Letter from the City Manager recommending adoption of a resolution designating
<br />a site for festival events and public celebrations including Portside and The Festival Market
<br />Place designated as the Olde Harbour Market in the City of Portsmouth.

<br /> "It has been recommended by our Tourism Coordinator, Ms. Kathy McCarty, that a resolution
<br />be approved to designate PORTSIDE and the Olde Harbour Market a site for festival events and
<br />public celebrations. The purpose of the resolution is to exempt the site from the Sunday
<br />Closing Laws. In order to permit merchants at the new site to sell on Sunday it is necessary
<br />that City Council render approval.
<br />
<br /> The attached resolution has been prepared to conform with the applicable requirements of
<br />the Sunday Closing Law. It is therefore recommended, and ~ concur, that you adopt the attache
<br />resolution."

<br /> On motion of Mrs. Webb and seconded by Mr. Gray, the following resolution was adopted,
<br />and by the following vote:
<br />
<br />"A RESOLUTION DESIGNATING A SITE FOR FESTIVAL EVENTS AND PUBLIC CELEBRATIONS
<br />INCLUDING PORTSIDE AND THE FESTIVAL MARKET PLACE DESIGNATED AS THE OLDE HARBOUR
<br />MARKET IN THE CITY OF PORTSMOUTH, VIRGINIA.
<br />
<br /> WHEREAS, the City of Portsmouth, together with its chosen instrumentality, the Portsmouth
<br />Redevelopment and Housing Authority, and as part of the Waterfront Redevelopment Project ap-
<br />proved by the City, has caused~to be erected a site for festival events and public celebratiom
<br />designated as Portside which includes the Festival Market Place designated as the Olde Harbour
<br />Market and thb adjacent waterfront in the City of Portsmouth, Virginia; and
<br />
<br /> WHEREAS, the waterfront
<br />is titled in the name of the
<br />Authority; and
<br />
<br />property on and adjacent to Portside and the Olde Harbour Market
<br />City of Portsmouth and/or the Portsmouth Redevelopment and Housin
<br />
<br /> WHEREAS, Portside and the
<br />be, among other things; a site
<br />provided for in ~18.2-341 (a)
<br />
<br />Olde Harbour Market are specifically designed and constructed
<br />for festival events and public celebrations or gatherings as
<br />(21), Code of Virginia, 1950, as amended.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that
<br />Portside, including the Festival Market Place to be known as Olde Harbour Market, and the
<br />publicly owned waterfront property adjacent thereto which is more particularly described here-
<br />in-below is designated as a site for Festival events and public celebrations:
<br />
<br /> Beginning at the southeast right-of-way of Harbor Court and Crawford Parkway;
<br />thence east along the south right-of-way of Harbor Court 310.83'; thence southeast
<br />42.31'; thence~south 64' to the line of a concrete seawall; thence east 307.16'
<br />to a line of a bulkhead in the Southern Branch of the Elizabeth River; thence south-
<br />erly along said bulkhead line a distance of 1,985' + to a point; thence west 224'
<br />+ to the east right-of-way of Water Street; thence ~orth and thence west along said
<br />~ight-of-way to its intersection with the east right-of-way of Crawford Parkway;
<br />thence north along Crawford Parkway to its intersection with the south right-of-way
<br />of Harbor Court, the point of beginning.

<br /> BE IT FURTHER RESOLVED that this resolution shall be in effect from and after its
<br />adoption."

<br /> 84-61 - Letter from the City Manager recommending adoption of a motion to refund Norman
<br />C. Bonenberger $188.00 for 1983 Personal Property Tax without interest.
<br />
<br /> "The Commissioner of the Revenue is requesting a refund of 1983 Personal Property taxes
<br />in the amount of $188 to Norman C. Bonenberger, 3201 Granada Road, Portsmouth, Virginia.
<br />
<br /> Mr. Bonenberger paid Personal Property taxes to Gloucester County where his boat was
<br />berthed since the fall of 1982. The taxpayer paid Personal Property taxes to Portsmouth in
<br />error.
<br />
<br />I recommend that Council adopt this~motion, and a refund be granted without interest."
<br />
<br /> Mation of Mrs. Webb and seconded by Mr. Gray, that authorization be granted to refund
<br />to Norman C. Bonenberger $188.00, without interest, in error paying Personal Property taxes
<br />to the city, and was adopted by unanimous vote.

<br /> "The Commissioner of the Revenue has requested that refund be made to Browning-Ferris
<br />Industries of South Atlantic, Inc., 2652 East Indian River Road, Chesapeake, in the amount of
<br />$6,468.30 for 1980, 1981 and 1982 City Busines Licenses.
<br />
<br /> The firm erroneously purchased a Business License in the City of Portsmouth, as well as
<br />other localities, for a number of years. It is the opinion of the Attorney General's Office
<br />that they should have been paying on their total gross receipts solely to the City of Chesa-
<br />peake where the business is located.
