<br /> Motion of Mrs. Wehb:'and seconded by Mr~ G~ay-~, to concur in the recommendation of the
<br />Planning Commission, GHP 84-2 for four (4) apartment units on the west side of Maryland
<br />Avenue between Wesley and Detroit Streets, was approved on first reading, and by unanimous
<br />vote.

<br />Thomas G. Midgette, 1354 DeBree Avenue, Norfolk, was available to answer questions.

<br /> 84-75 - The followingcordinance approved on first reading at the regular meeting of
<br />February 28, 1984, was taken up and read:

<br />FOR THE 1984 COMMUNITY DEVELOPMENT PROGRAM."

<br /> 84r85 - Letter from the City Manager ~ecommending adoption of an ordinance
<br />$100,000 from the Capital Improvement Fund for reconstruction of railroad grade
<br />Frederick Boulevard, Portsmouth Boulevard, and ~iCtc~ Boulevard.
<br />

<br /> "On November 1, 1983, Council adopted a resolution requesting that Seaboard Systems Rail-
<br />road, Inc., make improvements to five (5) crossings within our City. Discussions since that
<br />time, with various attorneys, relative to the City's request have been fruitful.
<br />
<br /> In order to proceed with the necessary improvements the attached appropriation for
<br />$100.00 must be approved.
<br />
<br />It is therefore recommended, and I concur, that the attached ordinance be adopted.!'
<br />
<br /> Motion of Mr. Barnes and seconded by Mr. Gray, to approve the ordinance on first reading
<br />with the understanding that the City Manager and staff ~ouldiworkL~ith the railroad companies
<br />to implement an on-going program that would be ~eneficial bdth to the railroads and the City,
<br />and a report be furnished on the matter.
<br />
<br /> Substitute motion of Mr. Whitlow and seconded by Mrs. Webb, that the matter be deferred
<br />to the meeting of April 10, 1984 for the City Manager and staff to have an opportunity to
<br />continue their negotiation with the railroads before deciding on what appropriation, or any,
<br />would be appropriate, and was adopted by unanimous vote.

<br /> 84-86 - Letter from the City Manager recommending adoption of an ordinance closing a
<br />portion of an unnamed alley on the west side~of Rodman Avenue.
<br />
<br /> "Attorneys for Thomas C. Culpepper, Robert B. Quinn, Jr., John Parrish and Sol Soroko,
<br />all of whom own property on the west side of Rodman Avenue, have made application to close a
<br />portion of a 10 foot alley across the subject property in order that the surrounding parcels
<br />~can be combined to develop same for commercial use. In accordance with the applicable State
<br />law, City Council app6inted viewers on January 10, 1984, and their report was forwarded to
<br />the Planning Commission for consideration.
<br />
<br /> The viewers' report raised questions concerning the use of the alley for trash and gar-
<br />bage clollection; however, the Director of Public Works has indicated!that suchlcollections
<br />are not made in the alley and that there are no plans to use same in the future. The Plannin
<br />Commission at its regular monthly meeting on February 7, 1984 voted unanimously to recommend
<br />to Council that the alley be closed.
<br />
<br /> A copy of the Planning Commissimn and viewers' report is attached for your consideration
<br />I recommend.adoption of the attachedcordinance closing a portion of an unnamed alley on the
<br />west side of Rodman Avenue."
<br />
<br /> The City Manager recommended deferral since the above letter was submitted, because of
<br />a conflict, he would like ~o get back with the individuals who live in the area, plus the
<br />developers.
<br />
<br /> Motion of Mr. Gray and seconded by Mr. Beamer, that the matter be deferred to the next
<br />meeting, March 27, 1984, and was adopted by unanimous vote.

<br /> 84-87 Letter from the City Manager recommending
<br />Article 2 of Chapter 21 of the Code, by adding 21-18.3
<br />and imitatiomcontrolled substances.
