Barnes, Ben A. <br />Holley, III, Gloria O. Webb, Morton V. <br />Steven Lieberman, City Attorney. <br /> <br />Beamer, Sr., J. Robert Gray, James W. <br />Whitlow, George L. Hanbury, City Manager, <br /> <br /> Rev. T. M. Frye, Pastor of Biltmore Baptist Church, opened the meeting with prayer, <br />followed by the Pledge of Allegiance to the Flag. <br /> <br />Mayor Johansen welcomed all visitors in attendance. <br /> <br /> Motion of Mr. Beamer and seconded by Mr. Whitlow, minutes of the called meeting of <br />February 28, 1984; minutes of the regular meeting of February 28, 1984, to be approved as <br />received, and was adopted by unanimous vote. <br /> <br />84-84 <br /> <br /> (a) <br /> <br />- Public Hearing on rezoning, use permit, and group housing project applications: <br /> <br />Z 83-26 <br /> <br />- Rezoning application of Elsie Green Hall, et als, by Carl E. Bowers <br /> of West Norfolk Associates, for a parcel of land at the northeast corner <br /> of West Norfolk Road and Cedar Lane; from Residential R-150 to Commercial <br /> C-1 and Office Residential OR-75. <br /> <br /> Glenn Yates, Jr., 445 Middle Street, representing West Norfolk Associates, requested that <br />C-1 zoning be eliminated and all of the parcel be rezoned for OR-75; he further stated that <br />the West Norfolk Civic League had agreed with the developers to consider rezoning a portion <br />from the center line of the egress to the east to OR-7S-K(Conditional). <br /> <br /> The City Attorney stated that the request for Conditional zoning did not conform to Con- <br />ditional zoning law requirements. <br /> <br />Mr. Yates stated that he would withdraw the request for OR-75-K(Conditional). <br /> <br /> George T. Arias, 4925 West Norfolk Road, representing West Norfolk Civic League, spoke <br />in support of OR~75 and stated that the Civic League supported OR-75-K(Conditional) for the <br />other portion. <br /> <br />Motion of Mr. Whitlow and seconded by Mrs. Webb, to approve the entire parcel as 0R-75. <br /> <br /> Motion of Mrs. Webb and seconded by Mr. Beamer to go into an executive session to dis- <br />cuss a legal matter, and was adopted by unanimous vote. <br /> <br />Council went into executive session at 7:40 plm. and reconvened at 8:04 p.m. <br /> <br /> Subs~itutee motion of Mr. Barnes and seconded by Mr. Beamer, <br />April 10, 1984, and that a public hearing be advertised in, order <br />legally, and was adopted by 6-1(Nay-Holley) vote. <br /> <br /> to defer Z 83-26 until <br />that the matter can be handle~ <br /> <br />(b) Z 84-3 <br /> <br />- Rezoning application of the Industrial Development Authority of the City <br /> of Portsmouth, by Gerald A. Burgess, Secretary, for property on the south <br /> side of Elliott Avenue between Frederick and Deep Creek Boulevards; from <br /> Industrial M-1 to Residential R-60. <br /> <br /> Motion of Mr. Gray and seconded by Mr. Beamer, to concur in the recommendation of the <br />Planning Commission, to rezone property on the southside of Elliott Avenue between Frederick <br />and Deep Creek Boulevards; from Industrial~M-! to Residential R-60, and gbp~fo~low~ngiordinanc~ <br />was(aP~ro~ed:7o~ ~st~ead~ngeby Unanimous vote: <br /> "ZONING AMENDMENT ORDINANCE Z 84-3" <br /> (c) Z 84-4 - Rezoning application of the Emily Green Home of the Portsmouth Baptist <br /> Association, Inc., by Kenneth E. King, President, for property at 410 <br /> and 500 Westmoreland Avenue.; from Residential R-75 to Office Residential <br /> OR-75-K (Conditional). <br /> <br /> Robe~ <br /> ~ ~ab~,~ ~gx 5~9~ Po~tsmo~h~,~Att~ney for the Petitioner, was available to <br />answer questions. <br /> <br /> Motion of Mr. Gray and seconded by Mrs. Webb, to concur in the recommendation of the <br />Plann&ng~nCommission, to rezone property at 410 and 500 Westmoreland Avenue, from Residential <br />R-75 to Office Residential OR-75-K(Conditional), and the ~l~o~i~g ordinance was approved on <br />first reading by unanimous vote: <br /> <br />"ZONING AMENDMENT ORDINANCE Z 84-4" <br /> <br />(d) Use Permit UP 84-3 <br /> <br />- Use Permit application of Emily Green Home of the <br /> Association, Inc., by Kenneth E. King, President, <br /> for adults at 410 and 500 Westmoreland Avenue. <br /> <br />Portsmouth Baptist <br />for a group home <br /> <br /> Motion of Mr. Gray and seconded by Mrs. Webb, to concur in the recommendation of the <br />Planning Commission, UP 84-3 for a group home for adults at 410 and 500 Westmoreland Avenue, <br />was approved on first reading and by unanimous vote. <br /> <br /> <br />
