<br /> WHEREAS, the application has been determined by the Planning Commission to have met the
<br />requirements of §40-55 of the Code of the City of Portsmouth, Virginia, 1973, as amended; and

<br /> WHEREAS, the Planning Commission has reviewed such application and site plan submitted
<br />therewith, and has recommended a conditional approval of said application; and
<br />
<br /> WHEREAS, the developer has been informed that approval of a Group Housing Project pursuanl
<br />to §q0-55 gran~s only an exemption from certain requirements for residences as stated in said
<br />section, and does not constitute a waiver of any other requirement embodied in the subdivision
<br />ordinance, zoning ordinance, the Code of the City of Portsmouth, Virginia, or any other appli-
<br />cable local, state or federal laws or regulations; and

<br /> WHEREAS, the developer is aware that building permits or any other recuired permit will b~
<br />issued only upon compliance with the ordinance, laws or regulations applicable thereto.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City
<br />certain Group Housing Project designated as GHP-84-S, and more
<br />prepared by Hoggard/Eure Associates, dated March 19, 1984, and
<br />officials of the City of Portsmouth, Virginia, and made a part
<br />al subject to the following terms and conditions:

<br /> 84-135 Letter from the City Manager recommending adoption of an ordinance to appropriate
<br />$222,000 for miscellaneous drainage projects in the City.
<br />
<br /> "The current Capital Improvement Program authorizes funds for "Off-Site Drainage and Hot
<br />Spots". Last year under the 1982-83 program you approved the following priority list:
<br />Jewell~Avenue, Harrower Court, Sykes Avenue, Staunton Avenue, and Airline Boulevard at Riddle
<br />Honda. In keeping with your established procedures, residential projects are 100% City funded
<br />with commercial projects requiring a 502 match by property owners. The following is $ listing
<br />of bids received:

<br /> Various members of Council have requested that a procedure be developed to allow for
<br />quicker response to Hot Spot projects which are minor in nature, but troublesome to property
<br />owners. To address this problem it is requested ~hat a total of $222,000 be appropriated.
<br />Projects small in nature and requiring only minor mmprovements could be handled administrative]
<br />at the direction of Council. Larger projects costing mn excess of $10,000 would still require
<br />a Council resolution to approve award of contract. The City Engineer has in£ormed me that the
<br />1983-84 Hot Spot priority list should be completed by the end of May and will be submitted to
<br />Mou for your review, comment and direction at that ~ime. The projects included to date are
<br />Manchester/Faber Road, Mayflower/Logan Drive, 200 block of Montclair, West Norfolk Road ditches
<br />Allen Street, and Greenland Boulevard. Other problem areas are being investigated and are not
<br />limited to the above and are contingent upon funding and our ability ~o secure required ease-
<br />~ents.

<br /> I recommend approval of an ordinance to appropriate $222,000 for Off-Site Drainage and Ho~
<br />Spot projects. A motion to award the contract for the 1982-83 program will be carried over to
<br />your May 8th meeting to coincide with second reading of the appropriatmon ordinance."

<br /> On motion of Mr. Gray and seconded by Mrs. Webb, the following ordinance was approved on
<br />first reading, and by unanimous vote:
