<br /> 84-179 Letter from the Cit) Manager recommending adoption of a resolutlcn autaoriz~ng
<br />the entering into a license agreement with Seaboard System Railroad, Inc., for installation of
<br />storm drainage pipes.
<br /> "As a part of our progr~ for 1985 "Hotspots" it is necessary to cross the right-a-way
<br />owned by Seaboard Systems Railroad, rnc.. For almos~ a year we have been discussing this matter
<br />with the railroad and a resolution has been prepared.
<br />
<br /> It is recommended that City Council adopt the attached resolution authorizing me to enter
<br />into a license agreement with Seaboard System Railmoad, Inc., for installation of s~orm drain-
<br />age pipes."
<br />
<br /> Motion of Mr. Gray and seconded by Mrs. Webb the following resolution was adopted and by
<br />the following vote:
<br />
<br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A LICENSE AGREEMENI
<br />WITH SEABOARD SYSTEM P~AILROAD, INC. FOR INSTALLATION OF STORM DRAINAGE PIPES.
<br />
<br /> WHER]~AS, the City of Portsmouth desires to make certain drainage in the vicinity of
<br />Airline Boulevard; and
<br />
<br /> WHEREAS, a portion of the planned
<br />drainage pi~s across the property of
<br />Mile Post SA-4; and
<br />
<br />drainage work requires the installation of concrene
<br />Seaboard System Railroad, Inc. in the vicinity of
<br />
<br /> WHEREAS, Seaboard System Railroad, Inc. has agreed to allow the City to construct, maintain
<br />and renew said drainage pipes.
<br />
<br /> NOW, tHEREFORE, BE IT RESOLVED b) the Council of the City of Portsmouth, Virginia, that
<br />the City Manager be, and ~e hereby is, authorized to enter into an agreement with Seaboard
<br />System Railroad,Inc. whereby said railroad grants un~o the City the right for license to install
<br />and maintain reenforeced concrete drainage p~pes ~cross the railroad's right-of-way at or near
<br />Portsmouth, Virginia commencing at a manhole located on the southeast side of the railroad's
<br />track at a point 697.82 feet northeast of Mile Post SA-4."
