August 14, 1984 <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY <br />AMENDING SECTIONS 20-9 AND 20-38 THEREOF, PERTAINING TO BUSINESS LICENSES." <br /> <br /> 84-286 Letter from the City Manager recommending adoption of an ordinance to amend <br />the Code of the City of Portsmouth, Virgmnia, 1973, by amending Section 35-19 and 35-20, <br />thereof, pertaining to personal property tax. <br /> <br /> (See letter under 84-285) <br /> On mormon of Mr. Whitlow and seconded by Mr. Beamer, the following ordinance was approve~ <br />on first reading, and was adopted by unanimous vote: <br /> "AN OREINANCE TO KMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY <br /> AMENDING SECTIONS 35-19 AND 35-20 THEREOF, PERTAINING TO PERSONAL PROPERTY TAX." <br /> 84-287 Letter from the City Manager recommending adoption of a resolution ro enter <br />into an agreement with Southeastern Public Service Authority of Virginia for use and support <br />of a solid waste disposal system. <br /> "As you know, last month SPSA made a major breakthrough by securing the necessary munic- <br />ipal approvals for the long awaited Refuse Derived Facility (RDF Plant). With theses sign- <br />off~, it:'now appears that construction of the facility can be initiated in the very near <br />future. <br /> <br /> As a result of these actions, SPSA has requested that the site of the City's Incinerator <br />be used oF a temporary basis as its transfer station. SPSA has agreed in concept ro the <br />tached cdntract prepared by the City Attorney's Office which requires that SPSA absorb all e::~ <br />costs associated with improvements to the site, along with demolition, once operations are <br />terminated (to include demolition of the City Incinerator). <br /> <br /> Until this recent breakthrough in negotiations, it appeared that a permanent transfer <br />station would have been required to serve the regional landfill. By utilizing the incinerator <br />smte on a temporary basis, SPSA can give strong consideration to locating the permanent ~aci- <br />lity as part of the RDF plant. <br /> <br /> Therefore, it is recommended that the attached resolution be approved authorizing the <br /> City Manager to enter into an agreement with SPSA for establishment of a temporary transfer <br /> station at the existing City Incinerator." <br /> <br /> On motion of Mr. Beamer and seconded by Mr. Whitlow, the following resolution was adopted <br /> and by the following vote: <br /> <br /> ~A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH <br /> SOUTHEASTERN PUBLIC SERVICE AUTHORITY OF VIRGINIA FOR USE AND SUPPORT OF A <br /> SOLID WASTE DISPOSAL SYSTEM. <br /> <br /> WHEREAS, by agreement dated April 7, 1983, the City of Portsmouth and Southeastern Public <br /> Service Authority of Virginia entered into an agreement for use and support of a regional <br /> solid waste disposal system; and <br /> <br /> WHEREAS, ~aid agreement provided for the construction of a permanent transfer site; and <br /> WHEREAS, Southeastern Public Service Authority of Virginia desires to use the present Cit <br /> incanerator property as a temporary transfer site until such time as a permanent transfer site <br /> can be cohs.t~ucted; and <br /> <br /> WHEREAS, Southeastern Public Service Authority of Virginia has agreed to pay the cost of <br /> demolition of the City incinerator upon completion-of its use as a temporary transfer site. <br /> NOW, THEREFORE, BE IT RESOLVED by the Council'of the City of Portsmouth, Virginia, that <br /> the City Manager be, and he hereby is, authorized to enter into an agreement with Southeaster~ <br /> Public Service Authority of Virginia for use and support of a solid waste disposal system to <br /> provide that a temporary transfer site may be located at the City incinerator property." <br /> <br /> Ayes: Beamer, Corprew, Gray, Lucas, Webb, Whitlow, Holley <br /> Nays: None <br /> <br /> 84-288 Letter from the City Manager recommending adoption of a motion to refund $4.36 <br /> to ,payid.~....Lev&~, trustee, for 1978 personal property taxes (with interest). <br /> <br /> "Tke Commissioner of the Revenue is requesting a refund of 1978 Personal Property taxes <br /> to David R. Lpyin, Trustee. <br /> <br /> .... ~. The~.~gspnal Property tax bill was overpaid in the amount of $.36. Therefore, a refund <br /> with interest is requested. Please forward refund to David R. Levin, Trustee, 430 Crawford <br /> Street, Portsmouth, Virginia 23704. <br /> <br /> I ~F.~2mm.~pd that Council adopt this motion, and a refund be granted." <br /> Motion of Mr. Gzay and seconded by Mr. Beamer, that authorization be granted to refund <br /> $4.36 to David R. Levin, Trustee, 430 Crawford Street, with interest, for overpayment on <br /> 1978 Personal Property taxes, and was adopted by unanimous vote. <br /> <br /> <br />
